Financial technology innovation that occurs nowadays leads to accelerated changes in the financial sector. However, these developments are like double-edged swords, on the one hand they provide convenience for consumers, on the other hand pose risks for consumers related to the confidentiality of their personal data. Money lending business through Peer to Peer lending (P2P lending) system often results in consumers receiving threats when they are late making payments. This paper presents several cases that result in consumers experiencing personal data theft, receiving threats directed at relatives or acquaintances. Even committing fraud by taking money from borrowers or customers without following the regulations made by the Financial Services Authority (OJK). The research data is carried out in a qualitative normative way where the data is translated based on legal norms and uses legal theory that can explain and answer existing legal problems.

Currently, lending fintech is proliferating. It is because of the high financing needs of the people who have not been reached by the banks. This article examines the phenomenon of illegal online loans in Indonesia and the government's preventive policies to deal with it. This article will be studied using a qualitative descriptive approach and using content analysis methods and literature review. In this article, the author argues that cybercrime does not only discuss online data theft or acts of harassment, but also relates to online loan crimes. The author also argues that the development of online loan crime is due to weak government regulations and policies. The government has tried to formulate legal regulations regarding the establishment of online loans legal and also legal rules that will protect victims of online loan crimes. However, in practice it still needs to be studied seriously and in depth. Many online loan crime cases are found in Indonesia, even during this pandemic it was reported that many online loan crimes were felt by the public. Therefore, through this online loan crime , the author wants to explore and examine more deeply about why online loan crimes are increasingly occurring among the public. How is the government trying to protect victims of online loan crimes by implementing the Financial Services Authority (POJK) Regulations, the Electronic Information and Transaction Law and other regulations? The popularity of peer-to-Peer Lending Financial Technology, or commonly known as online lending or loan, is growing in society especially during the pandemic. The improvement of online lending services has come as a business opportunity for most parties, affecting countless personal data collected by onlinebased loan service applications when consumers apply for loan program online. The liabilities of the corporates as electronic system providers that collect the data are vital to be investigated, especially regarding the companies providing loans online and disseminating user data when consumers fail to settle the debt. Law concerning Electronic Information and Transactions and Law concerning Personal Data Protection that serve as legal protection of the personal data do not clearly govern the liabilities over corporate negligence with their position as electronic system providers when the staff intentionally distributes and/or transmits and/or allow for access to the electronic information and/or electronic documents laden with mockery and defamation. This research was conducted based on a normative method, statutory, and conceptual approaches. The research results indicate that corporate liabilities for the dissemination of the data of the users of peer-to-peer lending are governed in Law concerning Electronic Information and Transactions and Law concerning Personal Data Protection but it is only restricted to intentional acts committed by companies. The dissemination of personal data caused by corporate negligence, however, is not governed strictly in laws in Indonesia.

Today's innovative industry is rapidly growing, fuelled by technology utilization and an increasingly diverse range of economic models. One of these models includes the rise of illegal financial technology peer-to-peer lending (illegal fintech P2P lending), which is increasingly gaining popularity within society. There exist various regulations designed to safeguard the personal data of debtors involved in illegal fintech P2P lending. This study employs a normative doctrinal approach utilizing three research methodologies: statute, comparative, and conceptual approach. The research reveals that while some standard rules have been elucidated, there lacks specificity regarding the responsible institution. The study collected information indicating numerous instances of debtors misusing personal data through illegal fintech P2P lending This highlights the continuous legal framework overseeing the balancing act of safeguarding personal data in Indonesia. comparing it to the typical legal principles governing personal data protection in other nations with principles on common law. Consequently, this study concludes that the current handling of debtors' personal data misuse in illegal fintech P2P lending by the Personal Data Protection Agency remains sectoral. It emphasizes the necessity for a more comprehensive, independent institution to offer optimal legal protection for debtors' personal data in the context of illegal P2P lending using fintech. POJK 10/2022 was issued by the Financial Services Authority to replace POJK 77/2016 with a new nomenclature. The difference in name certainly has implications for the substance or content of the regulation. The purpose of this study is to explain the regulation of fintech lending in POJK 10/2022, which replaces POJK 77/2016. This is normative juridical research, which uses a statutory approach to conceptualize law as a norm or rule that applies and becomes a reference for people's behavior. The data sources come from secondary data. According to the findings of the research, the regulation of fintech lending in POJK 10/2022 is more comprehensive than that in POJK 77/2016.
