Tako kot vsi ukrepi za varstvo otrokove koristi sta tudi odvzem otroka staršem in posledična namestitev drugam namenjena izključno varovanju otrokove koristi. Če je treba otrokovo koristi zaščititi, se mora država odzvati, in to ne glede na to, ali je med staršema tega otroka v teku kak postopek ali ne. V tujini (na primer na Hrvaškem) otroka iz matične družinske celice izločijo takoj, ko v razveznem postopku ugotovijo, da je postal sredstvo medsebojnega obračunavanja. Na tak način je otrok najbolje zaščiten, matična družina pa dolgoročno prav tako lahko le pridobi.

Modern glaciation is unevenly distributed between different regions of the Earth. Glaciers in Georgia are spread on the ridge of the Greater Caucasus concentrated in the Enguri, Rioni, Kodori, Tergi and some other rivers basins. The impact of current climate change on the glaciers is most visible in the changes in the characteristics of the glacial basins. The only way to scientifically study the effects of current climate change on glaciers is to use high-resolution satellite remote sensing, as this technology allows simultaneously studying the state of glaciers over a large area with the required resolution and accuracy, with limited material resources and restricted time. The authors address these issues along with SRS data using complex, integrated applications of historical data on glaciers (glacier catalogue), existing fieldworks, and expert knowledge. Hindu jurisprudence has played an important role in the formation of the basis and source of family law in Nepal. This article conducts an in-depth investigation of how Hindu legal principles have influenced the regulation of family law in Nepal. Through careful analysis, it outlines the historical development of Hindu jurisprudence and the way its influence manifests in Nepal's family law provisions, particularly under the National Civil Code 2017. It explores the historical foundations of Hindu law and identifies its practical consequences in the Nepalese context, including possible incongruities between Hindu law and its regulations. In doing so, it provides a deep insight into the complexity of the interaction between Hindu legal traditions and the structure of family law in Nepal. This article discusses in detail the historical development of the recognition of Hindu jurisprudence under Nepal's family law. It illustrates how key laws, such as legal arrangements for marriage, adoption, maintenance, or division, are influenced by Hindu scriptures. The article explains the provisions of the family law (enacted under the National Civil Code, 2017) in light of Hindu laws and practices prevalent in India. It also presents inconsistencies between Hindu laws and embedded regulations. This research approach integrates as legal research with a socio-legal approach, and a thorough literature review to uncover the impact of Hindu jurisprudence on Nepali family law, particularly under the National Civil Code 2017. Through these methods, this article strengthens the understanding of the complex relationship between Hindu legal tradition and family law regulation in Nepal. Reforma Družinskega zakonika je med drugim prinesla možnost odstopanja od zakonitega premoženjskega režima, ki je bil do sedaj obligatorne narave. Zakonca lahko s pogodbo o urejanju premoženjskopravnih razmerij odstopata od zakonitega premoženjskega režima. Tako je uvedeno spoštovanje avtonomije volje strank in dispozitivnosti pravnih norm na področju urejanja premoženjskih odnosov med zakoncema. V času, ko se ljudje zaradi oslabljenega gospodarskega položaja spopadajo s finančnimi težavami in nikakor ne najdejo izhoda, se jih vse več vse pogosteje poslužuje relativno novega instituta v naši državi, ki ga predvideva Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju), to je postopka osebnega stečaja, znotraj katerega se lahko predlaga tudi postopek odpusta obveznosti. Pomeni pa, da imata dve ali več oseb določen solastninski delež na celotni stvari, ki v sorazmerju s celoto predstavlja njegov idealni delež in je izražen v procentu oziroma ulomku. Solastnina nujno pomeni skupnost dveh ali več oseb kar v povezavi s tem odpira tudi vprašanja skupnega dogovarjanja glede upravljanja s stvarjo v solastnini. Pri solastnini namreč ni razdeljena stvar, ampak lastninska pravica. Navedeno nujno pomeni tudi sobivanje, zato je stvar v solastnini mogoče tudi (raz)deliti. Delitev se lahko opravi sporazumno, če sporazum ni mogoč pa pred sodiščem v nepravdnem postopku.

Osobna prava i dužnosti bračnih drugova sadrže ovlaštenja koja dovode do određenih promjena, a dijele se na ona prisilne i dispozitivne naravi. Ovlaštenja bračnih drugova da uređuju svoje odnose kao i da odlučuju o njihovu prestanku, rezultat su moći bračnih drugova. Osobna prava i dužnosti bračnih drugova imaju dalekosežno značenje jer iz njih proizlazi moć (ovlaštenje) održavanja stabilnih i skladnih obiteljskih odnosa. S druge strane, kod uređenja bračnih odnosa, zakonodavci uzimaju u obzir činjenicu da je obitelj temeljna društvena zajednica u kojoj ne mogu uvijek prevladavati stroge norme, nego u određenom stupnju postoje i norme koje omogućuju slobodu uređenja određenih odnosa. Osim toga, nacionalni zakonodavci uzimaju u obzir i europske standarde zaštite tih prava i dužnosti. Rezultat je toga taj da je danas moguće postizanje sporazuma o izboru prezimena, mjestu stanovanja, rađanju i podizanju djece te obavljanju svakodnevnih kućanskih poslova. Međutim, mogućnost sporazumijevanja nije predviđena za prava i dužnosti poštivanja međusobne ravnopravnosti, vjernosti, pomaganja i poštovanja, uzdržavanja te održavanja skladnih obiteljskih odnosa. Uz prisilnost, navedena prava i dužnosti bračnih drugova karakterizira i određeni stupanj moralnosti. Neovisno o kojoj se vrsti osobnih prava i dužnosti bračnih drugova radi, nepoštivanje svake od njih može rezultirati pravnom posljedicom – razvodom braka. Cilj je ovog rada uputiti na važnost pravne normiranosti osobnih prava i dužnosti bračnih drugova radi uspostavljanja ravnopravnosti između bračnih drugova. U tom smislu, ne treba promatrati samo pravnu stranu regulacije već i njezinu socijalnu dimenziju. Stoga se u radu, uz analizu relevantnih odredbi Obiteljskog zakona, predstavljaju i dostupni statistički pokazatelji vezani uz neka od osobnih prava i dužnosti bračnih drugova koji su, zasigurno, najrelevantniji pokazatelj učinkovitosti primjene zakonskih normi o uređenju osobnih prava i dužnosti. Isto tako, analizira se pravni značaj osobnih prava i dužnosti iz aspekta teorije prava te značaj preventivnog pristupa u suzbijanju njihovih povreda.

In numerous cases related to adoption, the European Court of Human Rights (hereinafter: ECtHR) emphasized the importance of a comprehensive approach to the adoption procedure as well as the best interest of the child, taking into account all the circumstances of the case. The denial of the right to consent to adoption leads to the violation of human rights, which is especially manifested to vulnerable social groups. The ECtHR also determined this type of violation of rights in the “Croatian cases” - X. v. Croatia and A.K. and L. v. Croatia, which dealt with the violation of the rights of persons with mental disabilities, more precisely, parents deprived of legal capacity and the right to parental care. The shortcomings determined by the ECtHR influenced the change of the adoption paradigm in the new Croatian family legislation from 2015. Therefore, the paper highlights the importance of a comprehensive approach to the adoption procedure by analyzing the Croatian family legislation and jurisprudence of the ECtHR related to “Croatian cases”. Likewise, newer cases decided by the ECtHR are analyzed, from which guidelines for further improvement of the adoption procedure and the protection of fundamental human rights are derived.

In what ways do transformations in indigenous family structures affect the evolution of private property laws? Prior to European colonisation, African political economies were predominantly agrarian, largely devoid of independent income, and strongly influenced by ancestral worship. Customary laws of property revolved on group notions of rights and obligations, which aimed at the welfare of the extended family. This communal setting promoted complementary gender relations, in which proprietary rights were shaped by people’s leadership, religious, and familial roles as eldest sons, senior wives, and unmarried daughters. European colonialism overturned this social setting by introducing radical socioeconomic changes into traditional communities. Notably, it created struggles for control of labour power, as Africans began to acquire wealth independently of family heads. Driven by factors such as capitalism, migrant labour, mechanised agriculture, and solo income, property relations became commodified, with intersectional effects on normativity. This chapter analyses transformations in family property relations under African customary laws. Informed by empirical insight and literature review, it argues that socioeconomic changes arising from globalisation prejudices women, girls, and younger male children and causes conflict between indigenous and state property laws. It shows how colonial assertions of control over political and labour power (re)created customary laws of property. The chapter highlights the significance of this (re)creation for state reforms of family property in conditions of legal pluralism.

Ireland is unusual in a succession law context as despite being a common law jurisdiction Irish succession law applies a comprehensive system of forced heirship for spouses under the Succession Act 1965. However, notwithstanding the strengths inherent in such a regime, shortcomings have emerged. This paper considers the position of the surviving spouse who has been disinherited, and the challenges they face in Ireland in the application of the legal right share towards the appropriation of the family home. In light of the difficulties identified, the paper proposes a new and alternative approach based on the provision of a preferential share representing a fixed monetary sum, subject to limitations. The proposal is then tested from both a theoretical and practical perspective. In England and Wales, notwithstanding the judicial development of guiding principles designed to underpin the application of the court’s discretion in the reallocation of assets pursuant to the Matrimonial Causes Act 1973, the financial consequences of divorce remain ‘largely discretionary’ (J Scherpe, ‘A Comparative Overview of the Treatment of Non-Matrimonial Assets, Indexation and Value Increases’ (2013) 25(1) CFLQ 61, 73). As Scherpe observes, ‘the overarching principle is to achieve fairness, which is a rather vague term, and section 25 of the Act [which enumerates the factors to be taken into consideration in the exercise of this judicial discretion] does little to instil more certainty’. In Ireland, in light of the even broader discretion afforded to the judiciary pursuant to the Family Law (Divorce) Act 1996 and the almost complete absence of judicially developed principles, arguably still greater uncertainty prevails vis-à-vis property division on divorce.

This paper considers the highly discretionary equitable redistribution scheme governing ancillary relief in Ireland pursuant to the Family Law (Divorce) Act 1996. The paper begins by drawing on the most up-to-data empirical data highlighting the principal difficulties inherent in the Irish ancillary relief system as currently applied and placing the spotlight firmly on the need for reform. It then considers the constitutional parameters that limit any change to the ancillary relief system applied before presenting a detailed proposal for reform. It concludes that although legislative change may be politically challenging, the commonly cited constitutional impediments to reform do not preclude the adoption of an alternative ancillary relief scheme. Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 memperbolehkan pembuatan
perjanjian perkawinan selama dalam ikatan perkawinan kedua belah pihak atas persetujuan
bersama. Hal tersebut menimbulkan ketidakpastian hukum bagi pihak ketiga. Permasalahan
yang akan dibahas yaitu apakah perjanjian perkawinan yang dibuat setelah perkawinan telah
sesuai dengan prinsip kepastian hukum bagi pihak ketiga. Tujuan dari penelitian ini yaitu
untuk menemukan bahwa perjanjian perkawinan yang dibuat setelah perkawinan tidak sesuai
dengan prinsip kepastian hukum bagi pihak ketiga. Pada penelitian ini digunakan pendekatan
yuridis normatif. Hasil dari penelitian ini yaitu perjanjian perkawinan yang dibuat setelah
perkawinan tidak sesuai dengan prinsip kepastian hukum bagi pihak ketiga karena perjanjian
perkawinan hanya sebagai upaya dalam melindungi kepentingan pihak yang membuatnya
yaitu suami istri tanpa memperhatikan kepentingan pihak ketiga yang tersangkut, sehingga
tidak tercipta suatu keadilan yang menjamin kepentingan para pihak.

Prawa własności intelektualnej od dawna stanowią istotne składniki majątkowe o znaczącej rynkowej wartości. Przewrót technologiczny oraz powiązane z nim cyfryzacja, automatyzacja i robotyzacja 1 pozwalają postawić tezę, że te niematerialne zasoby będą wciąż zyskiwały na znaczeniu. Analiza praw własności intelektualnej prowadzona jest zwykle z perspektywy ich znaczenia dla gospodarki oraz przedsiębiorców. Prawa własności intelektualnej mogą jednak często przedstawiać istotną wartość także w majątkach małżonków, co uzasadnia szczególne zainteresowanie tym zagadnieniem zarówno ze strony prawodawcy, jak i nauki prawa. Tymczasem problematyka przynależności praw własności intelektualnej do majątków małżonków nie stanowiła do tej pory przedmiotu licznych wypowiedzi w piśmiennictwie 2 , chociaż pewne trudności interpretacyjne mogą powstawać nawet przy definiowaniu podstawowych pojęć, wśród których na szczególną uwagę zasługują: "własność intelektualna", "dobra niematerialne" oraz "prawo własności intelektualnej". Podjęta próba usystematyzowania kwalifikacji praw własności intelektualnej do majątków małżonków wymaga w pierwszej kolejności zaprezentowania kwestii terminologicznych związanych z terminami "własność intelektualna", "dobra niematerialne" i "prawo własności intelektualnej". Dopiero po wyjaśnieniu tego zagadnienia omówić należy podstawowe założenia konstrukcyjne majątkowych ustrojów małżeńskich 3 i wynikające z nich zasady przyporządkowywania praw własności intelektualnej, które ustanawia Kodeks rodzinny i opiekuńczy 4. Motywem podjęcia rozważań na ten temat praw własności intelektualnej jako składników majątków małżonków jest dokonujący się przewrót technologiczny, w wyniku którego zmienia się własność i struktura czynników produkcji a aktywa intelektualne zyskująi będą zyskiwać na znaczeniu. W artykule przedstawiono w pierwszej kolejności kwestie terminologiczne związane z pojęciami „własność intelektualna”, „dobra niematerialne” i „prawo własności intelektualnej”. Dopiero po wyjaśnieniu tego zagadnienia omówiono podstawowe założenia konstrukcyjne majątkowych ustrojów małżeńskich i wynikające z nich zasady przyporządkowywania praw własności intelektualnej, które ustanawia Kodeks rodzinny i opiekuńczy. This paper shall be entitled as "Legal Implication of Post-Marriage Pre-nuptial Agreement". This paper shall apply normative legal research method combined with statutory approach in its composition. The purpose of this paper is to determine the regulation of the Pre-nuptial agreement and legal implication of post-marriage prenuptial agreement. Pre-nuptial agreement is regulated within the Law of Marriage and Family and the Civil Code. By laws, pre-nuptial agreement is composed in prior to the marriage, thus shall have its effect during the marriage. In contrast, should any prenuptial agreement failed to meet such requirement, the agreement shall be null and void.

RESUMEN: La House of Lords concluyó que el Derecho inglés y galés no había conocido todavía el régimen de comunidad de bienes bajo ninguna de sus modalidades. Pese a todo, la evolución del ancillary relief manifiesta una tendencia hacia la introducción de un régimen de comunidad "diferida" de bienes o de participación en las ganancias, desde mediados del siglo pasado. De hecho, recientemente, se ha tramitado un proyecto de ley que pretendía aproximarlo un poco más al concepto de régimen económico-matrimonial. Por esta razón, realizaremos un recorrido por el pasado, el presente y el futuro más próximo del ancillary relief con el fin de reflexionar acerca de la verdadera existencia de un régimen de comunidad de bienes en Inglaterra y Gales. The study aims to understand the juridical review of the transfer of inheritance rights to a land burdened with mortgage rights and the legal consequences of the heir's refusal to transfer inheritance rights to a land burdened with mortgage rights. This study is normative legal research (juridical) or literature law research. The results of the study show that : (1) the procedure for the transfer of rights over inherited Land which is being burdened with mortgage rights is carried out by recording them in the land book and certificate of mortgage rights in question and the land book and certificate of rights burdened based on a letter of evidence of the transfer of receivables guaranteed due to Inheritance, and (2) The legal consequences if the heirs reject the Inheritance of land rights that are being burdened with mortgage rights, namely that the heirs who expressly declare their rejection of their inheritance rights result in the heir being deemed to have never existed. The heirs' rejection of the Inheritance of land rights under the imposition of Mortgage does not result in the encumbrance of the Mortgage being annulled and rejecting Inheritance just because they don't want to pay off the Inheritance that is being burdened with mortgage rights.

Settlement of property is the transfer of property which may be jointly owned to the other spouse. It comes as a relief grant during divorce. The power of the court to share property is found in section 72 sub section 1, of the Matrimonial causes act 1970. Marital property is one of the matters over which angry divorcing spouses disagrees. Each party to a marriage seeking a divorce can apply to the court alongside with the divorce petition for settlement of property. It is only a marriage contracted under the Act i.e., marriage statutory marriage that settlement of property can be actualized which gives the court the power to share. In this piece of work, we shall be looking at how the court derives its power in a divorce for settlement of property in Nigeria, under Section 72(1) and other countries like England, and South Africa. We shall be looking at the comparative analysis of these countries on the issues of settlement of property their procedures law and Act. And also, we shall be looking at several cases relating to dissolution of statutory marriage in Nigeria.

Pregledni znanstveni rad Sažetak U Hrvatskoj istospolni partneri svoju zajednicu mogu sklopiti samo kao de facto zajednicu te će ona kao takva proizvoditi određene učinke, ako su ispunjene zakonom predviđene pretpostavke. Ipak, mogućnost nasljeđivanja na temelju zakona nije jedan od tih učinaka. Treba naglasiti kako je de facto istospolna zajednica po mnogočemu vrlo slična de facto izvanbračnoj zajednici, no postoje i brojne razlike. Za ovaj rad najznačajnija razlika leži u činjenici da izvanbračni drugovi jedan drugoga mogu nasljeđivati na temelju zakona, dok istospolni to mogu jedino kao oporučni nasljednici. U ovom radu, dakle, bit će govora prvenstveno o nasljednopravnim učincima de facto zajednica-i izvanbračne i istospolne, odnosno nepostojanju istih. U radu je naglašena činjenica da je ovakvo razlikovanje glede učinaka koje navedene de facto zajednice imaju, odnosno, nemaju u nasljednom pravu, utemeljeno jedino na spolu osoba koje tvore odnosnu zajednicu, što predstavlja diskriminaciju istospolnih partnera. Također se naglašava kako ne postoji nikakav pravni razlog da se zakonsko nasljeđivanje istospolnih partnera nije dopustilo u postojećem zakonskom okviru na temelju manjih intervencija u Zakon o nasljeđivanju. Ključne riječi: istospolna zajednica, izvanbračna zajednica, formalna/de facto zajednica, zakonsko nasljeđivanje, brak osoba istog spola. 1. A responsabilidade por dívidas do casal tem interesse não só para as relações entre os cônjuges, mas também para os credores da insolvência que anseiam pela satisfação dos créditos devidos. O Código de Insolvência e Recuperação de Empresas regula de modo inteiramente inovador a insolvência de pessoas casadas em regime da comunhão de adquiridos ou de comunhão geral. No presente trabalho, analisamos a dívida da responsabilidade de um cônjuge ou ambos os cônjuges na constância ou pendência do casamento, bem como o direito do cônjuge do devedor insolvente de reclamar a separação da massa insolvente os seus bens próprios e a sua meação nos bens comuns. Concluímos que responde pela massa insolvente os bens próprios ou comuns do casal, tendo em conta o regime económico matrimonial.

Without assuming prior legal knowledge, books in the Directions series introduce and guide readers through key points of law and legal debate. Questions, diagrams and exercises help readers to engage fully with each subject and check their understanding as they progress. The trust law that applies to family land might not be applicable to other types of land. Resulting trusts present a particular challenge in this regard. Although the doctrines of resulting trust have long been settled in the law of trusts, they have recently been questioned in the context of the family home. This chapter focuses on informal trusts of land and the social reasons why they are recognised, first looking at the problem of informality before turning to the different kinds of informal trusts of land. It also examines whether facts give rise to a resulting trust or a constructive trust, the practical significance of the distinction between constructive and resulting trusts of land, the relationship between proprietary estoppel and constructive trust, express agreement plus detrimental reliance, and the decision of the House of Lords in Stack v Dowden. The chapter concludes by considering some of the problems addressed by, and caused by, the operation of informal trusts in the context of cohabitation.

However, the status of adopted children in inheritance laws can be complex and raises various legal issues. The study explores the concept of adoption and its implications on the inheritance rights of adopted children. It analyzes relevant provisions of the Indonesian Civil Code and other related legal texts to understand the legal status of adopted children as heirs.
