ATTENTION ART MAKERS by Stop-Ai-replace on DeviantArt (original) (raw)

I love to bring some good news about the regulation of AI between America and Europe! I'll copy from everything written by Hammerpaws_ for those that isn't dipping their toes in there. If you love reading, then this will be enlightening ride.

The Twitter thread: twitter.com/Hammerpaws_/status…
"The EU has pushed for an AI regulation that will be negotiated over the next few months. Additionally, the US Copyright Office has set some guidelines in the field of AI art. If you're an art creator, you'll like reading this thread!

==========

The EU has been pushing through an AI regulation bill in which they "recognize that AI art could be dangerous to people's rights." This includes any kind of AI, the general purpose ones like ChatGPT, Bard, etc, and the non-general ones, like any kind of AI art maker.

Its reach could be dangerous as they could be used to forcibly take people's information, images, texts and copyright ownership. Experts in artificial intelligence are concerned about its increased usefulness and openness to the public.For this reason, during the next months, the EU block will negotiate a regulation that will force AI to deduct the use that people give it and the texts, images and any type of information that it uses THAT IS UNDER COPYRIGHT. This means AI developers must respect copyright.This is a big step forward. Most artists get mad at AI promoters and AI art machines because artists won't agree to share their artwork to encourage the creation of a machine that aims to replace them and make their creations/services cheaper.This regulation will only impact the EU countries (the countries in the Europe Union block). Additionally, the AI regulation law project promoters are encouraging more of this project around the world, specifically the US and China.If the EU regulation law becomes a real thing, the AI art machines will become useless for big corporations As you should know, the ownership of copyright is vitally important for big corporations.

==========

Now, stepping on the US Copyright Office's guidance post. This office recognizes that "under the US Constitution, anything that is not human (animals, natural phenomena, or machines) cannot retain copyright ownership."
The Office also concludes that an AI artist is only an instructor in the development of AI-made art. The artist provides instructions on what they want as result, and the AI works under those instructions, but also develops its own from a vast database of copyrighted works.This is more of a big hit than what you think. It implies that any type of AI creation is not protected under copyright, and so its derivations (sons), as they explain in their post. Conserving the copyright of its creations is vitally important for big corporations, here's why.Let's pretend Disney hired an AI artist to rework Mickey Mouse. The AI artist used entirely AI art machines to complete the work. According to the US Constitution, the AI won't retain copyright ownership over its creation, making it useless because no one can claim it.By using the creation of this AI, everyone could use it for commercializing purposes. Anyone could use it to trade. This encourages large corps not to hire AI artists if they'll not retain ownership of their creations, driving AI art machines out of the realm of professional art.Now, speaking about the low area. You can have a final conclusion out of what I've just told you. If you commission an AI artist, I am afraid to tell you that you cannot claim its creations as your own, since they were made by an AI and its creations cannot be copyrighted.This means that its creations and derivatives (including artwork, characters, objects, etc.) are not protected by copyright and everyone can use them for whatever they want. I hope you don't want a stranger to use your characters as their own.The Office also recognizes that "under the US Constitution, any art expression and product (coming as an art piece, a book, a song, etc) is protected by copyright." This means that your non-commissioned art pieces are protected by copyright and this could not be used in AI learn.In addition, the Office questions the ethics of developing AI art machines that base its algorithm on copyrighted artwork. We hope they recognize that no one can use my copyrighted creations if I don't want to, and prohibit big pages from selling their databases to nurture AIs.==========

As a last hope, I want to encourage both artists and watchers to keep supporting the human artist field, as we spend a lot of hours practicing and making to fulfil their dreams. We are a vast community and we need to take care of our basic income, as a way of life.I had to skip some threads about this new guidance post from the US Copyright Office because this thread is meant to reassure artists and their future in the field of art. AI art machines won't take your seat in the US or EU, don't worry. You are legally protected!We hope everyone learns to value human-made art over AI-made art. As history taught us, art has always survived in its own way. And we faithfully hope that the rest of the world will obey these new regulations and guidelines. If you think I missed something, please share! ^^
