It can be extremely unsettling to receive notice that your company’s #privacypractices have triggered a government investigation. But with all the new #privacylaws now in effect, and more funding for staffing up agencies, many companies are facing these. So a big 🙏 to Celine Guillou Ariane Mole and Jessica B. Lee for a content full discussion at IAPP #PSR in our panel today about the California Privacy Protection Agency and #CNIL investigatory processes, triggers for investigations and agency priorities, and practical things a company can prioritize now to ideally not get on the agency’s radar. There were lots of helpful takeaways. A few that come to mind include: - Consumer complaints. The CPPA has received over 3000 privacy complaints and CNIL over 30,000 privacy complaints. It shows that as consumers learn more about their privacy rights, many are motivated to do something about it if they feel their rights are not being honored. The agencies read all of them and it brings attention to your company (it’s not just big tech getting all the attention). Monitor and track the privacy complaints you receive and respond and resolve them. Lots of these complaints are being ignored. - the CPPA is also getting complaints from company whistleblowers about privacy practices that don’t sit right with them. Also referrals from other agencies. - Government enforcers shop too. So do their family members. If they notice a bad privacy experience, that can be a trigger. (Admittedly, privacy practioner family dinner topics can also include kid reports of bad cookie banners and odd requests for data🤓). - Hearing Ariane discuss CNIL’s Dawn Raids makes me appreciate CIDs. 🤣 I also want to now see the ICO’s Data Police jackets hanging in a museum next time I get to visit the UK. - CNIL’s concern with data being requested and how it’s used in connection with digital receipts is a topic that we’ll surely see pop up in the US too. - if you approach a regulatory investigation as a litigation fight right at the outset, spoiler, you’re likely to escalate it into a more contentious expansive inquiry. You can be strategic and a strong advocate through effective dialogue and engagement. - Come prepared to tell the story of your program and visibility into compliance roadmap if certain aspects are still a work in progress (better than saying we forgot or ignored). Also cryptic answers to questions without demonstrating that you in fact have a program (not just a policy) addressing the areas at issue is not going to prevent them from following up with more questions. Saying it was a technical problem also doesn’t get much sympathy.
