New Automatic Renewal Laws (ARLs) and amendments to existing #ARLs have proliferated throughout the U.S. in recent years. In 2024, California amended its heavily litigated ARL, and the #FTC issued its long-anticipated Final Negative Option Rule, including its “click to cancel” rules. California and the FTC are joined by a host of states that have recently adopted or strengthened their statutes. In a January 29 webinar, Christine M. In a significant development for the #digitalasset industry, the Southern District of New York certified for an interlocutory appeal its prior Order finding #crypto assets fall within the purview of the #SEC. This is an extremely rare procedure that allows the U.S. Court of Appeals for the Second Circuit to immediately address a critical question: Whether, under the factors set forth by #SCOTUS in its seminal Howey decision, crypto transactions can be deemed to be “investment contracts” and therefore can be regulated under the federal securities laws.
