Over the past few weeks, our attorneys have been active in several industry communities by attending and participating in panels and conferences. Here's what they've been up to: - Member Andrew Skale recently spoke on a panel about patent litigation and patent prosecution hosted by the Intellectual Property Law Association at the University of San Diego School of Law. Andrew provided valuable insight to law students on what a career in intellectual property law might look like. - Our Real Estate practice hosted The Builders of Color Coalition and NorthBridge Partners’ Coffee Connectors 2024 CRE Student Summit. With nearly 120 attendees, this event connects underrepresented college students with career opportunities in the commercial real estate sector. - Co-Chair of our Mergers & Acquisitions Practice Dean Zioze attended MedTech Collaborative’s 2024 Northern New England Med Tech Conference which Mintz was proud to sponsor. - Associate Adam Falconi participated in Harvard Business School’s Healthcare Alumni Association’s Annual Conference where he engaged with top leaders in life sciences to discuss the latest developments in venture financing, health care policy, and investment trends. Environmental Practice Chair Jeff Porter was quoted by Bloomberg Law in an article about President-Elect Trump's selection of Rep. Lee Zeldin as EPA administrator and how the pick is expected to support PFAS restrictions and roll back regulations governing wetlands. Member Richard Gervase was quoted by IAM in an article about an increase in the sale of drug royalties over the past two months, including the monetization of a patent deal relating to the world's first approved CRISPR-Cas9 therapy, Casgevy. He says, "Synthetic royalties are a flexible form of financing. For a company that does not receive royalties (but rather will be commercializing the product itself), synthetic royalty transactions are a good way to raise capital on the basis of the value of a specific asset." Of Counsel Carolina Säve and Associate Robert Sweeney wrote an article in the Boston Bar Journal addressing software-related IP considerations in transactions. The piece addresses why it is essential for both buyers and sellers to be aware and proactive to minimize associated risk. The authors write, "At the outset of any software asset deal, buyers need sufficient insight into the source code that underlies the asset to quickly identify issues that could adversely impact deal value. The parties’ initial non-disclosure agreement should contain sufficiently strict confidentiality measures, need-to-know access limitations, and provisions that allow the buyer’s technical representative to review the related source code." Canadian business leaders and investors convened at Mintz’s Toronto office this morning for an event entitled, “Dealing with the Decision: The Impact of the US Elections on Cross-Border Dealmaking.” Matthew T. Simpson, Co-chair of our Private Equity Practice, moderated a discussion with Hon. Lisa Raitt, Vice-Chair of Global Investment Banking of CIBC, Regan W., Founder of Fratton Park Inc., and Jonathan Wood of Control Risks. Panelists shared their perspectives on how they are advising Canadian companies who conduct business with the US and factors to consider under the incoming Trump administration, including the Canadian government’s investment in security and defense, manufacturing tariffs, anticipated regulatory changes, and more. We are honored to be one of two US law firms invited by Oxford University to serve as an expert pro bono contributor to its Climate Policy Monitor, an annual report on global climate regulations which launched today. The study comes at a critical moment as the world confronts a persistent “implementation gap” between climate targets and results. Mintz’s ESG Co-chair Jacob Hupart, along with attorneys Ellen Shapiro and Will McKitterick, collaborated on Mintz’s submission, focusing on three key areas of US federal government regulation: climate-related disclosure, transition planning, and public procurement. Their analysis will inform the United Nations Secretary General’s Taskforce on Net Zero Policy and was featured at the November 2024 UN Climate Conference.
