This article will address possible conflicts between the UN Drug Conventions and Human Rights tre... more This article will address possible conflicts between the UN Drug Conventions and Human Rights treaties, specifically in regard to countries committing human rights violations in applying drug laws. Considering that human rights are at the core of the UN System and, together with development, and peace and security, represent one of the three pillars of the United Nations enshrined in the UN Charter, it is preposterous that drug policies applied by UN Members violate the individual and social rights provided for in many international instruments that are assumed to be binding to state’s interventions. Nevertheless, there are many examples of human rights violations, such as the death penalty for drug offenses, inhumane treatment imposed on drug addicts, violations of individual guarantees in criminal cases involving drugs, and the prohibition of substances such as the coca leaf, traditionally consumed in the Andes in South America, that will be examined in this chapter.

In Prado and Trebilcock’s book, Institutional Bypasses: A Strategy to Promote Reforms for Develop... more In Prado and Trebilcock’s book, Institutional Bypasses: A Strategy to Promote Reforms for Development, the authors identify what they call a spontaneous bypass. These are alternatives that emerge as decentralized individuals and groups look for substitutes for a system that is not working as it could or should1. Although these spontaneous bypasses - often called “workarounds” - are created as uncoordinated solutions, collectively they offer alternative pathways to dysfunctional institutions. By looking at ways people have sought to work around such roadblocks to development, the authors suggest, we can better understand the dynamics of a dysfunctional system and find ideas that might be used for reform.
In Brazil we might see training in law schools for advanced corporate law practice as a suboptimal system surrounded by several bypasses or “workarounds”. In this paper, we identify this as another potential case study, in addition to the ones discussed in the book, analyze its (perverse) implications and outline a possible research project on this topic.
O texto aborda a relação entre as convenções internacionais sobre drogas e os tratados de direito... more O texto aborda a relação entre as convenções internacionais sobre drogas e os tratados de direitos humanos, tema ainda muito pouco debatido no Brasil. Do ponto de vista formal, coexistem, de um lado, o sistema internacional sobre drogas, extremamente repressivo, o qual, apesar de datar do século passado, é amplamente aceito e seguido por muitos países; e, de outro, o sistema internacional de proteção aos direitos humanos, que tem avançado significativamente na elaboração de tratados, reconhecendo e buscando efetivar direitos humanos com base no conceito de dignidade humana. A partir da perspectiva de Cançado Trindade e seu conceito de "razão humanitária" se propõe a interpretação dos tratados internacionais de controle de drogas à luz do marco internacional dos Direitos Humanos.
