As the problematic we underline the following question: how are the human rights of the refugees granted at the present time? The hypothesis we propose is that despite of the stagnation of the Institute of Refuge at the end of the XX century, currently with legislation and public policy evolution, Brazil has been searching for means of strengthen the protection of the humanitarian rights to the refugees. The general objective consists of the analysis about how the human rights are granted to the refugees that come to Brazil in this century.
