O presente artigo discorre sobre o reconhecimento da família multiespécie dentro do ordenamento j... more O presente artigo discorre sobre o reconhecimento da família multiespécie dentro do ordenamento jurídico brasileiro. Busca-se apresentar o conceito de família, quais os tipos de família previstos expressamente na Constituição da República Federativa do Brasil de 1988 ou no Código Civil Brasileiro e quais os princípios norteadores do direito da família. Ademais, busca-se demonstrar que o atual conceito de família se baseia no princípio da afetividade e, portanto, a família multiespécie é uma categoria que merece proteção do ordenamento jurídico brasileiro. Demonstrando que apesar do reconhecimento da doutrina, o Poder Judiciário não reconhece a família multiespécie em face da ausência de previsão legal. O método utilizado para realização do presente trabalho foi o dedutivo, no qual já se considera a existência da família multiespécie, enquanto que a técnica de pesquisa foi baseada em pesquisa de jurisprudências e doutrinas. As the problematic we underline the following question: how are the human rights of the refugees granted at the present time? The hypothesis we propose is that despite of the stagnation of the Institute of Refuge at the end of the XX century, currently with legislation and public policy evolution, Brazil has been searching for means of strengthen the protection of the humanitarian rights to the refugees. The general objective consists of the analysis about how the human rights are granted to the refugees that come to Brazil in this century. The specific objectives are: to briefly present the historic evolution of the human rights, the Brazilian legislation regarding the refugees as well as the regulator and coordinator office for the refugees (CONARE) and to enlighten the development of the human rights and the measures taken in the XXI century regarding the protectio...
