The subject of this paper is an analysis of the provisions of article 4 of the European Conventio... more The subject of this paper is an analysis of the provisions of article 4 of the European Convention of Human Rights [European Convention] compared with, in particular, the provisions of article 8 of the International Package of Civil and Political Rights. The prohibition of slavery is then analysed in sensu stricto, including trading in slaves, followed by an analysis of the prohibition of servitude in different contexts as presented in reasons for judicial decisions delivered by the European Court of Human Rights [ECHR] in Strasburg. The provisions of Convention No 29 and Convention No 107 of the International Labour Organisation on forced labour and its abolition, sincevthey played an im-portant role in the ECHR judgments, are given most attention. Likewise, excerpts of article 4 clause 3 of the European Convention regarding: prisoners’ work, military service, including alternative military service, extraordinary circumstances and ordinary civil duties are widely discussed. The European Social Charter in both its versions-the original from 1961 and the revised one from ... more The European Social Charter in both its versions-the original from 1961 and the revised one from 1996, attaches great importance to the protection of children's rights. It sees the fate of unaccompanied minor foreigners in the territories of states-parties to the Charter as a special problem. Three complaints directly address this issue: two by Defense for Children International against the Netherlands in 2008 and against Belgium in 2011, and one by EUROCEF against France in 2015. They were settled by the European Committee of Social Rights in 2009, 2012, and 2018, respectively. The rulings adopted by the Committee provide an important framework for the response of public authorities in Europe to the increasing number of children arriving from other continents. The adopted directions of thinking indicate the need for great sensitivity in applying the applicable legal standards to this category of foreigners. The article indicates the essential elements that should be taken into account when deciding on the legal situation of minor foreigners coming to Europe.

Some situations in which social rights can be subject to limitations have been discussed in specific examples. In addition, the article contains numerous references to jurisprudence along with the comments and comments of the author who takes up the polemic.
