В статье анализируются правовая природа, законодательное закрепление и применение института орган... more В статье анализируются правовая природа, законодательное закрепление и применение института организационного группового иска в Российской Федерации как процессуальной формы судебной защиты коллективных прав и интересов граждан. В отечественном процессуальном законодательстве существуют аналоги общеизвестных моделей представительских групповых исков «opt-in» и «opt-out». Однако иск общественной организации в защиту неопределенного круга лиц («opt-out») и иск организации в защиту прав и интересов персонифицированной группы лиц («opt-in») существенно различаются с групповым иском в классическом виде. В действующих процессуальных кодексах отсутствует порядок рассмотрения исков уполномоченных законом общественных объединений в защиту других лиц в порядке группового производства, в связи с чем требования организаций рассматриваются судами в порядке обычного искового производства. Отсутствие механизмов (от подачи иска до вынесения решения) судебной защиты «профессиональными истцами» коллективных прав и публичного (общественного) интереса в зависимости от общепризнанных мировых практик вовлечения заинтересованных лиц, чьи права были нарушены, создает препятствия для развития института общественного группового иска в России. Автором предлагается обеспечить возможность некоммерческим организациям выступать с групповым иском в защиту группы лиц, чьи права были нарушены вне зависимости от их членства в такой организации, а также создавать общественную организацию ad hoc специально для предъявления конкретного группового иска.

Class action is an important safeguard to protect the rights and legitimate interests of large gr... more Class action is an important safeguard to protect the rights and legitimate interests of large groups of people and it has already proven successful in advanced foreign legal systems. One of the most popular forms of class action in countries with a continental legal system (France, Sweden, Argentina) is a representative action, which is initiated by non-profit associations, i.e., " ideological claimants " (associations, foundations, non-profit organizations) in defense of violated collective rights of a large group of people or unspecified persons in the most vulnerable areas of economic life. The institution of collective redress by representative bodies is less popular in countries with common law legal systems (the USA, Australia, Canada), which traditionally use class actions. Nevertheless, countries with common law legal systems such as the United Kingdom (England and Wales) actively use the legal tools for the social protection of the violated rights and interests of citizens. This article analyzes the legislative consolidation and application of representative actions in the Russian Federation. The absence of a mechanism (for filing a lawsuit before the decision) of judicial protection of professional representatives' collective rights and public interests according to the generally accepted international practices involving interested persons whose rights have been violated (opt-in or opt-out), creates barriers to the development of representative actions in Russia. At the same time, the scope of these claims and the judicial protection of collective rights and public interests by public associations has its own characteristics, which can be used by legislators to effectively protect human rights.

One of the most popular forms of class action in countries with a continental legal system (France, Sweden, Argentina) is an public class action, which is initiated by non-governmental associations, the so-called "ideological claimants" (associations, foundations, non-governmental organizations) in defense of violated collective rights of a large group of people or unspecified persons in the most vulnerable areas of economic life.
The institution of collective protection of the rights in countries with a common legal system received smaller expansion (USA, Australia, Canada), which are traditionally used representative class actions. Nevertheless, countries with a common legal system, as the United Kingdom (England and Wales) actively use the tools of social protection of the violated rights and interests of citizens.
At the same time, the scope of these claims and the mechanism (from suiting a case before adjudication) judicial protection of collective rights and public interest non-governmental associations has its own characteristics, which can be used by Russian legislators to effectively protect the population.

Th... more At the moment the judicial law-making in the Russian law there is a special form of lawmaking. The main feature of judicial law-making is its secondary character, due primarily to the fact that the main function of the court — the administration of justice in which law enforcement prevails over any other activity. Since there is a judicial law-making, law-making trial results are sources of law. There is a source of a special kind: on the one hand, they are by-law character, and on the other — can modify or even repeal the law. However, the current judicial system in the Russian Federation has led to the realization that courts rule the law often differently. This does not serve the cause of the uniform application of the law on the territory of the Russian Federation and ultimately undermines the legitimacy and authority of the state, also that forms a nihilistic attitude to the law in general.
