Article 25 of the Italian Statute on Private International Law states that companies are governed... more Article 25 of the Italian Statute on Private International Law states that companies are governed by the law of the country where the company was incorporated and that, however, Italian law shall apply if the administrative seat or the main object of the company is located in Italy.
Is the latter part of this rule compatible with EU principles on freedom of establishment?
This was recently asked by the Italian Supreme Court (Corte di Cassazione), which brought the matter before the Court of Justice of the European Union.
The article attempts to answer the question.

This paper shows why a modernization of the EU law on the freedom to provide information society services in the internal market is urgently needed in order to guarantee a level playing field and which legal principles, conceived in a wholly different economic and technological context, are now, in the digital era, obsolete.

e Cali Apartments) rendono particolarmente vivo ed attuale il dibattito sulla regolamentazione dei servizi di alloggio tramite piattaforma digitale. Numerosi
host di Airbnb ricorrono alla formula della locazione breve per mascherare
un’attività di fatto imprenditoriale. Così facendo, si sottraggono all’applicazione
delle regole amministrative e fiscali imposte ai tradizionali operatori del settore,
giovandosi di un illegittimo vantaggio competitivo nei confronti di questi ultimi.
Per questo motivo le associazioni di categoria invocano l’introduzione, a livello
nazionale e locale, di regole volte a prevenire la concorrenza sleale degli host.
Tuttavia, nel regolare i servizi di alloggio peer-to-peer gli Stati membri devono
fare i conti coi princìpi europei sulla libera prestazione dei servizi. Purtroppo,
però, il quadro giuridico è piuttosto incerto ed occorre modernizzare le norme
europee sulla libera prestazione dei servizi

Digital ridesharing platforms and transportation network companies such as Uber have not been reg... more Digital ridesharing platforms and transportation network companies such as Uber have not been regulated in most European countries yet, including Italy. The current legal framework is obsolete and should be revisited as soon as possible , as new disruptive technologies bringing new regulatory challenges are just around the corner (e.g. robotaxis and decentralized transportation platforms). However, reforming the ride market is not an easy task. Looking at the experience of the few European countries that have already adopted a new regulation might help. A possible solution could be to introduce a light regulation of transportation network companies while reducing the regulatory burdens on taxis.

Different courts found Uber to have committed unfair competition practices against taxi drivers and radio taxi providers in the public transportation market. This paper aims at showing that Uber cannot be considered a competitor to radio taxi providers, since the latter do not provide a transportation service, but act only like intermediaries.
