Belgium has a highly-open economy, with the majority of the gross domestic product (GDP) generate... more Belgium has a highly-open economy, with the majority of the gross domestic product (GDP) generated by the service sector. It is also completely tied to economy of Europe. In the past half-century, the country prospered as a modern, technologically advanced European state and member of NATO and the EU. Belgium's GDP grew by 1.7% in 2017 and the budget deficit was 1.5% of GDP. After terrorist attacks in March 2016 which mainly impacted the Brussels region tourist and hospitality industry, Belgium's economy recovered in large measure. Prime Minister Charles MICHEL's center-right government has committed to further reduce the deficit in response to EU pressure to decrease Belgium's high public debt of about 104% of GDP, but such efforts would also dampen economic growth.

Today proportionality analysis (PA) is an inclusive principle of constitutional adjudication, the... more Today proportionality analysis (PA) is an inclusive principle of constitutional adjudication, the preferred procedure for managing disputes involving an alleged conflict between two rights claims, or between a rights provision and a legitimate state or public interest. With "new constitutionalism" PA become popular for constitutional and supreme courts around the world. From German origins, it spread across Europe. In this paper Author's goal is to explain why judges would be attracted to PA and then to trace the process through which PA has been adopted. Reductive theory of third-party dispute resolution (TDR) occurs while two parties are debating and ask a third-party for help, they build a consensual act of delegation or mode of governance. The 2-against-1 dilemma worsened by the shift to adjudication. It happens in two ways; the judge's authority is fixed by the office and compulsory jurisdiction and adjudicators will make law. The "new constitutionalism " has spread all around the world and it has no opponent yet. It is based on the principle that rights and effective rights protection are elementary to the democratic legitimacy of the state. Therefore it rejects legislative sovereignty model those ideologies with one person or party underconstrained political authority. Constitutional judges' basic task is to resolve conflicts: legal disputes in which each party pleads a constitutional norm or value against the other. Balancing cannot be disassociated with lawmaking: it requires judges to behave as legislators do. PA does not provide exact answers to legal problems, instead, it offers the optimal possible advice available for judges. It is an argumentation framework which openly indicates to litigating parties the type and sequence of arguments that can and must be made and the path through which the judges will reason to their decision. In situations where the judges cannot escape stating a winner, they can at least make a series of ritual bows for losing party. Several reasons can be listed to explain why balancing holds sway. Some of them are; rights provisions are relatively undecided norms and the fact that most rights provisions are not absolute but are capable of being limited by another value of constitutional rank which stated by most post-WW-II constitutions. It is constitutional and supreme courts' core function to supervise it. Solving the conflict between two principles is possible by balancing; the judge should find one principle outweighs the other.

This thesis addresses the integration problems of immigrants living in Germany by presenting a co... more This thesis addresses the integration problems of immigrants living in Germany by presenting a comprehensive discussion of the integration and immigration policies and by discussing the related effects on the labour market.
The challenges regarding the integration of migrants have become clearly visible in daily life. A clear example of it could be the ghetto communities living in their own neighborhoods. These ghetto communities currently are the neighborhoods where immigrants are able to fulfil their needs by themselves. By doing so, they do not interact with local people outside.
The integration problem that immigrants face is a dynamic topic which is an urge to solve. Hence forth, it has been discussed at the national, European and worldwide level. Clearly, countries that are willing to promote more open and liberal migration policies, have to give more importance to integration policy. As implementation of the integration policies is a long process itself, governments should monitor that procedure closely. Immigrants’ situation has to be monitored, in order to understand whether they could integrate into society or not. Because of the fact that the failure of integration might cause deeper effects on society and the labour market.
This thesis is meant to point out the characteristics and employment status of different immigrant groups according to their nationals together with the distinction of gender, occupation and age. The conclusions are made regarding the investigation of differences in the country of origins and overqualification rate. Furthermore, it is supported by the analyses of unemployment rate between immigrants and natives in the labour market.
