The work is focused on the new profiles of civil liability that can arise in the event of a traff... more The work is focused on the new profiles of civil liability that can arise in the event of a traffic accident between two vehicles, at least one of which is (semi)autonomous. In this scenario, starting from a critical analysis of the state of the art, the work achieves two aims thanks to an interdisciplinary research method applied. First of all, it evaluates whether there is a civil liability regulation which is functional to the protection of the injured person, even in the event of a traffic accident due to a semi-autonomous or fully autonomous vehicle. Secondly, it verifies whether this legislation is sufficient for complete and systematic regulation of autonomous vehicles, or if it is necessary to modify the existing regulation and, eventually, to introduce an ad hoc framework of rules for self-driving cars accidents.

On the contrary, sustainabil- ity can be understood as a socio-legal challenge characterised by the desire to pursue a common ideal: the protection of the environment in the interest of the present and future generations, guaranteeing a green technological innovation. In the context of the environmental protection in relation to the development of new mobility tech- nologies, e-mobility represents one of the sectors capable of changing the transport- pollution binomial, in particular when it is associated with the development of new technologies, not intended as a limit to environmental protection but as its enhance- ment, representing an evident example of synergy between digitalization, automation and decarbonisation. the paper sets out the analysis of the state of the art in the field of smart e-mobility in road traffic to address the main challenges and opportunities for the automotive sector. It will be demonstrated how an effective framework of private law rules could make road mobility more sustainable, smart and resilient, putting mobility technologies at the service of the human being under a trustworthy and anthropocentric approach.

ABSTRACT ITALIANO: Molteplici sono le politiche governative per la promozione dello sviluppo soci... more ABSTRACT ITALIANO: Molteplici sono le politiche governative per la promozione dello sviluppo socialmente responsabile delle nuove tecnologie, anche nel settore automobilistico, al fine di ridurne l’impatto ambientale. Tuttavia, risulta necessario affiancare e attuare tali iniziative attraverso la disciplina di determinate fattispecie giuridiche di interesse strategico nei rapporti tra soggetti privati. In questa prospettiva, il lavoro mira ad individuare possibili strumenti di diritto privato a garanzia di un’adeguata tutela degli individui e dell’ambiente, con particolare riguardo al bilanciamento tra evoluzione tecnologica ed ecosostenibilità nel settore della mobilità stradale. Ciò nella duplice prospettiva di una tutela ex ante ed ex post dei soggetti di diritto coinvolti nello sviluppo dell’industria automobilistica.

ABSTRACT ENGLISH: Many government policies are in place to promote the socially responsible development of new technologies, also in the automotive sector, in order to reduce their environmental impact. Nevertheless, it is necessary to support and implement these initiatives through the regulation of certain legal cases of strategic interest in relations between private parties. In this perspective, the work aims to identify possible instruments of private law to guarantee adequate protection of individuals and of the environment, with particular regard to the balance between technological evolution and eco-sustainability in the road mobility sector. This is in the double perspective of ex-ante and ex-post protection of the subjects of law involved in the development of the automotive industry.

Nel XXI secolo, la tutela dell’ambiente ricopre più che mai un ruolo di primaria importanza e si presenta come questione centrale nelle agende dei governi di tutto il mondo. Tuttavia, se la necessità di tutelare la natura appare evidente, soprattutto nel periodo di profonda crisi ambientale che stiamo vivendo, ciò che è ancora in discussione è come intervenire per ottenere una tutela realmente efficace. Il presente contributo parte da un’analisi comparata della differente qualificazione giuridica della natura in Italia e in alcuni Stati dell’America Latina, analizzando le due tesi di senso opposto che vedono, l’una, la natura quale bene giuridico e, l’altra, la necessità di soggettivizzarla. Al termine dell’analisi critica del binomio soggetto-oggetto di diritto, si tenterà di individuare un efficace intervento normativo per la tutela della natura in un’ottica ecosostenibile.

In the 21st century, the protection of the environment plays a role of primary importance more than ever and presents itself as a central issue on the agenda of governments all over the world. However, if the need to protect nature appears clear, especially in this period of deep environmental crisis, what is still under discussion is how to intervene to obtain truly effective protection. This contribution starts from a comparative analysis of the different juridical legal qualification of nature in Italy and in some States of Latin America, analysing the two opposite theses: the first one considers nature as a legal good and the second one that poses the accent over the need to subjectivize it. At the end of the critical analysis of the two categories of subject and object of the law, an attempt will be made to identify an effective regulatory intervention for the protection of nature in an eco-sustainable perspective.

Considerevole appare, di conseguenza, l’impatto delle nuove tecnologie sulla regolamentazione dei modelli giuridici: in particolare, sarebbe possibile configurare la responsabilità del produttore in caso di difetto degli ADAS o del veicolo autonomo, in aggiunta alla responsabilità del conducente ovvero in sostituzione di questa.

Nowadays, it is very current the issue of liability in road traffic related to advanced driver assistance systems (ADAS) and, in an evolutionary way, to autonomous vehicles. Consequently, it appears considerable the impact of the new technology on the regulation of the legal models: in particular, it could be possible to set up the manufacturer’s liability in case of an ADAS’ or autonomous vehicle’s defect, in addition to the traditional driver’s liability or in its substitution.

This information is personal data, and so is regulated by Reg. 679/2016/EU, commonly known as General Data Protection Regulation (GDPR). But is this European legislation sufficient to offer the necessary protection to users of self-driving cars? In particular, an important question is whether consent to the processing of personal data is really functional to achieve the objectives set out in the GDPR or whether further protection is required.

Smart toys are devices with the appearance of traditional children’s toys (e.g. dolls or cuddly t... more Smart toys are devices with the appearance of traditional children’s toys (e.g. dolls or cuddly toys) but they are capable of interacting with the surrounding environment, connecting to the Internet and using technological systems. They are robots, characterized by a more or less developed level of automation, to the point that the most recent models of connected toys are equipped with artificial intelligence. Although smart toys are fun and sometimes even educational games, they are still tools that collect, process and communicate data, with possible risks, especially for minors. Indeed, first of all it is very concrete and serious the risk of unlawful processing of minors’ personal data, but also the risk of hacker attacks, issues related to possible emotional bonds between the minor and the toy, as well as psychical manipulation.
This paper will deepen the concept of smart toys, starting from the characteristics and the technical aspects and then moving on to the analysis of their possibilities and risks, in order to identify the possible legal remedies to be foreseen for protecting minors.

Among other things, it discusses the requirements and the role of the driver, the homologation of self-driving cars and the regulation of the different types of data used and produced by autonomous driving systems, considering the different levels of automation identified in the SAE standard J3016.
The recent development of autonomous vehicles asks for regulatory intervention, in relation to road safety and privacy. Therefore, after analyzing the state of the art on road traffic regulation, the contribution proposes the analogical application of some rules relating as well as the introduction of ad hoc legislation for autonomous driving.

InsurTech is an economic and legal phenomenon concerning the application of new technologies and,... more InsurTech is an economic and legal phenomenon concerning the application of new technologies and, in particular, Artificial Intelligence, to the insurance sector. The phenomenon is emerging not only in the international and European panorama but also in the Italian one.
In this regard, the paper describes the development of InsurTech in the Italian Legal system and analyse the state of the art of its regulation.
The focus of the paper is on the relationship between Artificial Intelligence and the insurance sector, in specific concrete areas of application: firstly, the change of the insurance sector thanks to the spread of new technologies, as Internet of Things (IoT), and, secondly, the insurance sector applied to Artificial Intelligence devices, such as the case of driverless cars and that of software as a medical device (SaMD).
Finally, the paper discusses the perspective of the insurance sector in the light of the AI evolution.

The paper aims to describe the sources of law needed to solve issues in data protection, with par... more The paper aims to describe the sources of law needed to solve issues in data protection, with particular regard to DPO tasks. In order to elaborate this work, two preliminary steps have been carried out. The first one is focused on the critical analysis of the Euro- pean and Italian law in the field of data protection. The sources of law include both hard law and soft law, with particular regard, for the second one, to the code of conduct. The second step is to define the relevant topics for DPOs, which are the matters that a DPO has to know to better perform his or her tasks in compliance with the GDPR, explaining the reasons underlying their selection.

The work verifies the efficacy of consent to the processing of personal data with specific regard... more The work verifies the efficacy of consent to the processing of personal data with specific regard to the awareness of the users and of its related risk. In order to carry out the evaluation, a subsample of users involved in the experiment went through an extended questionnaire (see Q48 – Q59), including additional questions related to the awareness of choosing specific privacy settings and their consequences. Concretely, the work analyses the added sections from III.I to III.IV of the questionnaire, that is focused on the consent to the processing of personal data. The users’ choices and the legal content of every single step of the software installation process is the object of the experiment carried out.

In particular, the main differences between W10 version 2016 and W10 version 2019 concern the implementation of privacy and security in compliance with GDPR principles and in relation to the users’ behaviors. Completed this analysis phase, it will be underlined the need of straightening the ex ante protection in terms of (i) rethinking the privacy policy and (ii) remodeling of the instrument of the consent as the legal basis for the processing, as well as, more in general, (iii) fortifying the principles of privacy and security by design and by default.

The development of autonomous vehicles generates several issues regarding the application of the ... more The development of autonomous vehicles generates several issues regarding the application of the traditional categories of private law to this new scenario and leads to wondering if existing legislation can still be applied. Indeed, the work is focused on the new profiles of civil liability, and the related insurance aspects, that can be configured in the event of a traffic accident between two vehicles, at least one of which is autonomous. The chapter takes the perspective of the Italian legal system and concerns the identification of the principles and function of Italian tort law and insurance law, also taking into account of private international law matter.
Starting from a critical analysis of the Italian state of the art, the chapter will try to achieve two aims. First of all, it will evaluate whether the Italian regulation is functional to the protection of the injured person, even in the event of a traffic accident due to an autonomous vehicle. Then, it will argue if the Italian legislation is sufficient for complete and systematic regulation of self-driving cars or if it is necessary to modify the existing regulation to introduce an ad hoc framework of rules for self-driving cars.

This information is personal data, and so is regulated by Reg. 679/2016/EU, commonly known as General Data Protection Regulation (GDPR). But is this European legislation sufficient to offer the necessary protection to users of self-driving cars? In particular, an important question is whether consent to the processing of personal data is really functional to achieve the objectives set out in the GDPR or whether further protection is required.

Smart toys are devices with the appearance of traditional children’s toys (e.g. dolls or cuddly t... more Smart toys are devices with the appearance of traditional children’s toys (e.g. dolls or cuddly toys) but they are capable of interacting with the surrounding environment, connecting to the Internet and using technological systems. They are robots, characterized by a more or less developed level of automation, to the point that the most recent models of connected toys are equipped with artificial intelligence. Although smart toys are fun and sometimes even educational games, they are still tools that collect, process and communicate data, with possible risks, especially for minors. Indeed, first of all it is very concrete and serious the risk of unlawful processing of minors’ personal data, but also the risk of hacker attacks, issues related to possible emotional bonds between the minor and the toy, as well as psychical manipulation.
This paper will deepen the concept of smart toys, starting from the characteristics and the technical aspects and then moving on to the analysis of their possibilities and risks, in order to identify the possible legal remedies to be foreseen for protecting minors.

Among other things, it discusses the requirements and the role of the driver, the homologation of self-driving cars and the regulation of the different types of data used and produced by autonomous driving systems, considering the different levels of automation identified in the SAE standard J3016.
The recent development of autonomous vehicles asks for regulatory intervention, in relation to road safety and privacy. Therefore, after analyzing the state of the art on road traffic regulation, the contribution proposes the analogical application of some rules relating as well as the introduction of ad hoc legislation for autonomous driving.

InsurTech is an economic and legal phenomenon concerning the application of new technologies and,... more InsurTech is an economic and legal phenomenon concerning the application of new technologies and, in particular, Artificial Intelligence, to the insurance sector. The phenomenon is emerging not only in the international and European panorama but also in the Italian one.
In this regard, the paper describes the development of InsurTech in the Italian Legal system and analyse the state of the art of its regulation.
The focus of the paper is on the relationship between Artificial Intelligence and the insurance sector, in specific concrete areas of application: firstly, the change of the insurance sector thanks to the spread of new technologies, as Internet of Things (IoT), and, secondly, the insurance sector applied to Artificial Intelligence devices, such as the case of driverless cars and that of software as a medical device (SaMD).
Finally, the paper discusses the perspective of the insurance sector in the light of the AI evolution.

In order to elaborate this work, two preliminary steps have been carried out. The first one is focused on the critical analysis of the Euro- pean and Italian law in the field of data protection. The sources of law include both hard law and soft law, with particular regard, for the second one, to the code of conduct. The second step is to define the relevant topics for DPOs, which are the matters that a DPO has to know to better perform his or her tasks in compliance with the GDPR, explaining the reasons underlying their selection.

In order to carry out the evaluation, a subsample of users involved in the experiment went through an extended questionnaire (see Q48 – Q59), including additional questions related to the awareness of choosing specific privacy settings and their consequences. Concretely, the work analyses the added sections from III.I to III.IV of the questionnaire, that is focused on the consent to the processing of personal data. The users’ choices and the legal content of every single step of the software installation process is the object of the experiment carried out.

In particular, the main differences between W10 version 2016 and W10 version 2019 concern the implementation of privacy and security in compliance with GDPR principles and in relation to the users’ behaviors. Completed this analysis phase, it will be underlined the need of straightening the ex ante protection in terms of (i) rethinking the privacy policy and (ii) remodeling of the instrument of the consent as the legal basis for the processing, as well as, more in general, (iii) fortifying the principles of privacy and security by design and by default.

The development of autonomous vehicles generates several issues regarding the application of the ... more The development of autonomous vehicles generates several issues regarding the application of the traditional categories of private law to this new scenario and leads to wondering if existing legislation can still be applied. Indeed, the work is focused on the new profiles of civil liability, and the related insurance aspects, that can be configured in the event of a traffic accident between two vehicles, at least one of which is autonomous. The chapter takes the perspective of the Italian legal system and concerns the identification of the principles and function of Italian tort law and insurance law, also taking into account of private international law matter.
Starting from a critical analysis of the Italian state of the art, the chapter will try to achieve two aims. First of all, it will evaluate whether the Italian regulation is functional to the protection of the injured person, even in the event of a traffic accident due to an autonomous vehicle. Then, it will argue if the Italian legislation is sufficient for complete and systematic regulation of self-driving cars or if it is necessary to modify the existing regulation to introduce an ad hoc framework of rules for self-driving cars.

di MARIA CRISTINA GAETA Con sentenza n. 7469/2017, la Corte di cassazione ha rigettato il ricorso... more di MARIA CRISTINA GAETA Con sentenza n. 7469/2017, la Corte di cassazione ha rigettato il ricorso avverso la pronuncia della Corte d'Appello di Napoli n. 1484/2014 avente ad oggetto la separazione personale dei coniugi con addebito al marito. La Suprema Corte ha, altresì, dichiarato la congruità dell'assegno di mantenimento disposto in primo grado dal Tribunale di Napoli, osservando che l'importo liquidato appare proporzionato tanto alle esigenze del figlioormai maggiorennequanto ai redditi del padre, e che non sono sopravvenute nuove circostanze tali da incidere sul suo ammontare. La Corte di cassazione ha ribadito che l'addebito della separazione ha carattere eccezionale e presuppone comportamenti più gravi rispetto a quelli che, di regola, determinano la separazione personale dei coniugi sanciti dall'art. 151 c.c.: intollerabilità della prosecuzione della convivenza o grave pregiudizio per l'educazione dei figli. Nel caso di specie, infatti, l'intollerabilità della vita coniugale costituisce condizione necessaria e sufficiente per la pronuncia della separazione giudiziale e la colpa di uno dei coniugi rileva solo ai fini dell'addebito della separazione per violazione degli obblighi coniugali previsti dall'art. 143 c.c. Per decidere sulla configurabilità dell'addebito della separazione, la Corte si è attenuta al principiopiù volte affermatosecondo il quale è necessaria una valutazione comparativa delle condotte dei coniugi al fine di determinare la sussistenza di un nesso di causalità tra il comportamento di uno dei due coniugi e l'intollerabilità della convivenza (cfr. ex multis Cass. civ, sez. I, 20 agosto 2014, n. 18074; Cass. civ., sez. I, 27 giugno 2006, n. 14840; Cass. civ., sez. I, 11 giugno 2005, n. 12383). Nel caso in questione, la convivenza era divenuta intollerabile a causa dei comportamenti del marito, in quanto costui era venuto meno ai suoi doveri coniugali, primo tra tutti quello di fedeltà. Infatti, egli aveva intrapreso una relazione extraconiugale confermata da tutti i testi escussi, mentre le violazioni ascritte alla mogliecome la condotta offensiva e aggressiva tenuta durante la convivenza, la disponibilità manifestata a intraprendere nuove relazioni e la ripresa della frequentazione con un suo ex fidanzatonon erano state dimostrate. Per tali motivi, il Tribunale di Napoli aveva addebitato la separazione al marito e il Giudice di legittimità ha confermato la pronuncia rigettando il ricorso avverso la sentenza d'appello, ritenendo che l'allontanamento della moglie dalla casa familiare era stata una reazione alla scoperta del tradimento del marito e non costituiva, quindi, violazione dell'obbligo di coabitazione. Pertanto, il comportamento della moglie risulta essere l'effetto della frattura dell'unione tra i coniugi e non la causa.

Con l'ordinanza n. 17139/2017, la Corte di Cassazione ha rigettato il ricorso di un padre che ave... more Con l'ordinanza n. 17139/2017, la Corte di Cassazione ha rigettato il ricorso di un padre che aveva riconosciuto il figlio minore d'etànato fuori del matrimonioin un momento successivo rispetto alla madre e che chiedeva l'attribuzione del suo cognome al figlio. La pronuncia della Suprema Corte ha ripreso la giurisprudenza di legittimità sui criteri di individuazione del cognome del minore riconosciuto in tempi diversi dai genitori, i quali hanno la funzione di tutelare il diritto del minore alla identità personale, intesa anche come proiezione della sua personalità sociale nell'ambiente in cui è cresciuto. Pertanto, la scelta del giudice risulta ampiamente discrezionale: non è ammessa alcuna automaticità e il giudizio non può essere condizionato «né dal favor per il patronimico né per un prevalente rilievo della prima attribuzione» (ex multis, Cass. nn. 12640/2015 e 2644/2011). Secondo il Giudice Supremo chiamato a pronunciarsi sul caso in esame, la ratio dell'art. 262 c.c.che disciplina l'attribuzione del cognome al figlio nato fuori dal matrimonio -è quella di garantire l'interesse del figlio a preservare il cognome originario, qualora questo sia divenuto autonomo segno distintivo della sua identità personale, e la scelta del giudice deve essere funzionale alla tutela degli interessi del minore. Infatti, il diritto al nome costituisce un diritto fondamentale della persona tutelato dalla Costituzione (art. 22 Cost.), in quanto strumento identificativo di ogni individuo che prevale anche sul diritto di eguaglianza morale e giuridica dei genitori (artt. 3 e 29, co. 2, Cost.). Non appare logico, invece, ritenere che la norma abbia lo scopo di equiparare la posizione del figlio nato da una coppia non coniugata a quella del figlio nato in costanza di matrimonio, dato che tale distinzione è stata ormai ampiamente superata dal legislatore (L. n. 219/2012 e d. lgs. n. 154/2013). Per tali motivi, la Corte di Cassazione ha confermato l'impugnato decreto della Corte d'Appello di Firenze del 21 giugno 2016, che aveva rigettato la domanda volta ad attribuire il cognome paterno al minore, confermando il provvedimento di primo grado. In particolare, la Cassazione ha evidenziato come la decisione della Corte d'Appello sia stata dettata dalla necessità di tutelare gli interessi del minore, con particolare riguardo alla sua identità personale. Invero, all'esito dell'ascolto del minore che aveva compiuto i dodici annie che, dunque, doveva essere ascoltato ai sensi dell'ultimo comma dell'art. 262 c.c.risultava indubbio che lo stesso non volesse sostiuire né aggiungere il cognome del padre al proprio e una decisione in senso contrario avrebbe arrecato forti turbamenti al minore e accresciuto il sentimento di distacco e astio verso il padre.

In particolare, la madre del concepito chiedeva al giudice di essere autorizzata ad accedere alle due provette di sangue del convivente deceduto -che erano state conservate dall'azienda ospedaliera in cui egli era stato ricoverato prima del decesso -allo scopo di conservare elementi di prova, che rischiavano di essere alterati dal trascorrere del tempo, e porli poi a fondamento del futuro accertamento giudiziale della paternità, esperibile ai sensi dell'art. 269 c.c., in seguito alla nascita del concepito.

In fact, the existing rules do not directly address the problem of liability in the event of car collisions involving an autonomous vehicle. Even if the road traffic regulations provide some cases that can be applied to autonomous vehicles (in whole or in part), there is no complete body of law that​ allows identifying the related responsibilities and the tortfeasor.

Le norme sulla responsabilita civile extracontrattuale non affrontano direttamente il problema de... more Le norme sulla responsabilita civile extracontrattuale non affrontano direttamente il problema degl incidenti che coinvolgono almeno un veicolo autonomo e - anche se le norme sulla circolazione stradale prevedono alcuni casi che possono essere applicati a veicoli autonomi - non esiste una legislazione completa che permetta di identificare pienamente il responsabile in questo nuovo scenario. In particolare, le auto senza conducente potrebbero comportare il superamento della responsabilita del conducente e/o del proprietario del veicolo, nonche dei soggetti ad esso equiparati imputabili negli incidenti stradali. Cio comporta la necessita di analizzare il tradizionale schema della responsabilita civile extracontrattuale da circolazione stradale, al fine di verificare se sia necessario coinvolgere altri soggetti come ad esempio il produttore, il fornitore di servizi Internet e altre parti interessate (ad esempio gli hacker che possono manomettere il software di guida del veicolo).
