Between the 1930s and 1950s, the criminalist Giuseppe Bettiol devoted a great deal of attention t... more Between the 1930s and 1950s, the criminalist Giuseppe Bettiol devoted a great deal of attention to the dogmatic and methodological problems of criminal science, elaborating a general theory of crime analytically tripartite but hinged on a notion of formal and ethicalsubstantial anti-juridicality, as well as advocating, in terms of method, the adoption of a concrete logic oriented in a realistic and teleological sense. The present study aims at analysing comparatively Bettiol's theory of crime and concrete logic, searching for their common philosophical matrixes and trying to discern how each of them relates to the epistemological statute of criminal science and to the emergence of a classically characterised natural law.

For this purpose, taking in a comparative consideration three different models, the positivism, the axiologicalconstitutional one and the classical-metaphysical one, subjects such as the person, the teleological rationality and the natural law are analyzed and discussed in their foundational value and in their specific function.

The work explores the philosophical roots of the concept of criminal law developed by Giuseppe Be... more The work explores the philosophical roots of the concept of criminal law developed by Giuseppe Bettiol. Antonio Vernacotola, investigating the epistemological field, the " concrete logic " on the method and the philosophy of punishment, offers an interpretation of Bettiol's penal doctrine focused on a metaphysical realism which has its main theoretical references in Aristotle and St. Thomas.

The essay aims to develop a critical insight into the final part of Francesco Gentile’s legal philosophy, focused on the problem of justification, and also to check whether there is a continuity of inspiration with the earlier stages of his thought. To this end, some points of his doctrine, such as the problematicity of experience and the conversion of conflict into controversy, have been confronted with the rational process of constructing a theodicy of law, the landing point of his last work.

Starting from the category of «virtuality» that Francesco Gentile shows to be a characterizing tr... more Starting from the category of «virtuality» that Francesco Gentile shows to be a characterizing trait of modern thought, the present essay aims to reconstruct the modalities through which, beginning from the seventeenth century, a new anthropological model takes root. The notion of man is expunged from the metaphisical reflection and detached from reality to be structured on the basis of a purely conventional set of definitions. Conceived in this way, it is placed in the guise of paradigm of a legal political theory that is purported to be constituted in the form of scientific discipline. The concepts of individual, nature and freedom are made object of a semantic reconsideration, through which it is created a «virtual man», as determined according to the forms of a «unicity» towards which the dimension of intersubjective relation appears extraneous. Such a model, ultimately, proves to be functional, in accordance with an operational protocol, to the construction of a principle of sovereignity in which is fulfilled, in the words of Gentile, the secularization of the «divine» and the deification of the «politics».

theory of knowledge and his arbitrary voluntarist
theology. These two elements concur to establish
Hobbes’ political theology.

These papers bring new work on Hobbes’s late writings to bear on the Curley, Martinich, Wright, “... more These papers bring new work on Hobbes’s late writings to bear on the Curley, Martinich, Wright, “Calvin and Hobbes” debate, to show that each of these critics is partially right. Martinich is right about Hobbes’s theological seriousness, despite Curley being right about his use of irony as a rhetorical strategy, while Wright is surely right that it is a matter of submitting texts to a scientific hermeneutics. Hobbes, it turns out, as demonstrated by his late works, the Answer to Bramhall of 1666-7, the Appendix to the 1668 Latin Leviathan, and the Historia Ecclesiastica (c. 1659-71), displays a compelling consistency in his heterodoxy. To the use of irony, with which he sometimes disguises it, I would add paradox and banality as further registers in his repertoire of surrogacy, and of course texts in Latin, accessible only to the cognoscenti.
