L’intelligenza artificiale (AI), come accade in molti altri ambiti, ha preso il sopravvento anche... more L’intelligenza artificiale (AI), come accade in molti altri ambiti, ha preso il sopravvento anche nello sport in modo incredibile. In pochi anni, tutti gli aspetti dello sport, sia professionistico che amatoriale, sono stati mediati in un modo o nell’altro dall’IA. A tal punto che oggi atleti, arbitri, allenatori e tifosi hanno un rapporto totalmente diverso con l’attività sportiva rispetto a qualche anno fa*. Lo stesso vale per il personale medico, nutrizionisti e psicologi. Sicuramente l’intelligenza artificiale ha rivoluzionato la competizione e la medicina dello sport, l’allenamento, l’arbitraggio, la psicologia dello sport e l’alimentazione, ma anche il modo in cui tifosi, atleti e società si relazionano. Per non parlare dell’impatto dell’IA sulle scommesse sportive e dell’enorme business che rappresenta. Tutto ciò ha aspetti positivi, in particolare per quanto riguarda l’efficienza delle decisioni arbitrali, l’individuazione di infortuni o molestie nei confronti degli atleti. Ma anche aspetti negativi che possono compromettere molto seriamente il benessere e la sicurezza degli atleti e l’integrità della competizione.

European integration sets up a common acquis beyond state boundaries. Being a political actor in ... more European integration sets up a common acquis beyond state boundaries. Being a political actor in this process involves a commitment to the values on which the EU itself is founded and the rights it safeguards. European integration has paved the way for new ways of political participation that have given a voice to non state actors in this process. From this perspective, this contribution examines the legitimacy of nationalist claims inside EU member states as well as the states facing such claims. I shall argue that as long as both are committed to the common acquis, then both of them are equally legitimate to support their positions. But they are also required to settle these disputes by democratic means in line with that common ground.

Para ello presento tres consideraciones previas acerca de otras tantas cuestiones centrales para la teoría del positivismo jurídico internalista que defiende Redondo. Estas consideraciones se refieren al problema ontológico de las normas, al epistemológico y a la delimitación de la práctica de referencia. En el resto de los apartados realizo un análisis crítico de los argumentos ofrecidos por la autora y, en particular, de i) la vinculación entre punto de vista interno y compromiso moral y ii) la dicotomía objetivo/subjetivo referida a la ontología y epistemología de los deberes jurídicos.

Advances in scientific knowledge, especially sport psychology and neuroscience, seem to confirm this intuition and consequently it is possible to characterize elite athletes as having an extraordinary combination of physical and mental abilities. Techniques and substances that contribute to enhancing physical characteristics of athletes have also been well known for ages. But it is now possible to make use of other techniques and substances that not only enhance physical abilities but also cognitive capabilities, which seem to require greater consideration given their direct impact on the athlete’s brain. In this paper, I will challenge the basis of the distinction arguing that only the first part of it is related to health and, consequently, the distinction should be better understood as differentiating between qualitative and quantitative consequences of interventions. As health and normality are broad concepts inside of which it is possible to make some ulterior distinctions, I will propose three different senses of normality in order to more easily grasp the therapy/enhancement distinction. As with the distinction between therapy and enhancement, the difference between sports- and non-sports-persons is usually stated in terms of health and normality. I will challenge this assumption, too. In my opinion, the main difference between people, sportspeople and athletes should be related to the practice itself. It is assumed that AI will become a decisive driver of change in sport in the coming years. Indeed, AI's revolution in sport is already underway by the gradual replacement of humans by AI and high-tech systems, as is happening in refereeing and coaching. There are many benefits that AI can provide to sport, such as training improvement, assisted coaching, doping monitoring, injury prevention and so on. However, AI applications in sport are not without risk. Among them, the manipulation of athletes and competition are probably the most pressing. This paper is aimed at distinguishing among different AI uses in sport suggesting a normative and ethical framework that leads to an adequate use of AI in sport and consistent with the human values with which the Olympic Movement is committed.

Resumen: La inteligencia artificial (IA) ha irrumpido recientemente en el deporte, pero sus aplic... more Resumen: La inteligencia artificial (IA) ha irrumpido recientemente en el deporte, pero sus aplicaciones ocupan ya un lugar destacado en la práctica deportiva e irán sin en aumento en los próximos años. Son muchos los beneficios que estos sistemas de tecnología avanzada pueden proporcionar al deporte. Pero las aplicaciones de la IA en el deporte no están exentas de riesgos. Entre ellos, la manipulación de los deportistas y de la competición son probablemente los más acuciantes. Pero hay otros, como la modificación radical de la gobernanza del deporte y las competiciones deportivas que quedarán completamente mediatizadas por esta tecnología disruptiva. En este artículo propongo un marco jurídico y ético que nos permita disponer de un uso fiable de la IA y respetuoso con los derechos humanos de los deportistas y los compromisos éticos del Movimiento Olímpico. There are many benefits that such advanced technology can provide to sport. However, AI applications in sports are not without risk. Among them, the manipulation of athletes and the competition are probably the most pressing. There are also others, such as the radical modification of sport governance and sport competitions that will be completely mediated by this disruptive technology. In this article, I propose a legal and ethical framework that enables a reliable use of AI and consistent with the human rights of athletes and the ethical commitments of the Olympic Movement. 1. Introducción. Los sistemas de inteligencia artificial (IA) y la ingeniería tecnológica avanzada (advanced tech engineering) constituyen probablemente, junto con la edición genética, la expresión más acabada de la antigua aspiración humana de jugar a ser Dios. Por primera vez en la historia de la humanidad somos capaces de crear sistemas autónomos que, imitando el aprendizaje humano realizan tareas complejas de forma mucho más eficiente que los propios seres humanos. Los sistemas de IA calculan y predicen situaciones, aprenden de sus propios errores, o por ser más exactos de los errores padecidos en la programación, y adaptan constantemente su comportamiento a situaciones cambiantes hasta el punto de ser absolutamente independientes del control humano. ¿Es la gestación subrogada ética y moralmente reprobable en todo caso o hay situaciones en los qu... more ¿Es la gestación subrogada ética y moralmente reprobable en todo caso o hay situaciones en los que debe ser permitida? La distinción entre mala quia mala y mala quia prohibita cobra toda su relevancia en este asunto.
Los argumentos abolicionistas sostienen que la gestación subrogada constituye siempre y en todo caso un atentado contra la dignidad de la mujer (mala quia mala). Los contratos de gestación son así la expresión más repugnante de la lógica patriarcal que considera a las mujeres un mero objeto reproductor y a los niños y niñas gestados de este modo un bien de consumo al albur de las fluctuaciones del mercado capitalista.
Para quienes abogan por la regulación de la gestación subrogada las cosas no son tan sencillas. Hay casos en los que esta práctica es contraria a la dignidad de la mujer y, en consecuencia, no pueden tener cabida en un ordenamiento jurídico respetuoso con los derechos básicos de las personas. Pero hay también otros casos en los que la propia dignidad de la mujer exige respetar su voluntad de concluir un contrato de gestación con terceras personas. Son estos los casos que exigen una adecuada regulación jurídica que proteja a la mujer gestante y evite prácticas abusivas que pongan en riesgo su autonomía y libertad antes, durante y después de la gestación (mala quia prohibita) .
Los ensayos que componen este volumen tratan de dar respuesta a estas y otras cuestiones en torno a la gestación subrogada desde una perspectiva multidisciplinar que va desde la ética y la filosofía (Parte I) al derecho positivo (Parte II). Se trata con ello de presentar propuestas constructivas que ofrezcan argumentos de lege ferenda a la hora de deliberar públicamente sobre una cuestión tan controvertida política y jurídicamente. De alguna manera nos va la vida en ello.
