Social Inclusion For Persons With Disabilities Through Access To Employment In Indonesia

The aim of this article is to identify the forms of legal protection provided by the government to fulfil the right to work for persons with disabilities in Indonesia, and to know the path to produce a special working condition for persons with disabilities in Indonesia. This article is a normative study following legislative and a comparative approach. The results showed that the form of legal protection provided by the Indonesian government to persons with disabilities in fulfilling the right to work is set forth in Law Number 8 of 2016 as stipulated in article 45article 60. This form of legal protection covers the procedure of recruitment, acceptance, work preparing, work position, sustainability of work, and the development of a fair career consideration without discrimination. It is possible to realize an inclusive work environment for persons with disabilities in the workplace by fulfilling the principle of inclusion, which mandates awareness, accessibility, involvement, and support for persons with disabilities.

This study aims to analyze the implementation of state responsibilities in fulfilling the rights of persons with disabilities in the field of employment in Indonesia and the supporting and inhibiting factors of the state in fulfilling the rights of persons with disabilities in the field of employment. The method used in this research is normative legal research, with legal studies using legal systematics, research that will synchronize regulations, and make comparisons with applicable laws and use legal history. The study results found that the state fulfills the rights of persons with disabilities in the field of employment by providing protection and fulfillment of the rights of persons with disabilities. Supporting factors for social movements in voicing the fulfillment of the rights of persons with disabilities, which are accommodated by the Indonesian Association of Persons with Disabilities, are supporting factors for the fulfillment of facilities for persons with disabilities in public spaces. The inhibiting factor is that the fulfillment of the rights of people with other disabilities is still lacking; it is proven that facilities for people with disabilities often make the facilities that have been built at several points ineffective and ineffective. The concept of state responsibility in fulfilling the rights of persons with disabilities in the field of employment in Indonesia to obtain work and a decent living for humanity is a constitutional right guaranteed in the 1945 Constitution of the Republic of Indonesia

The absorption of workers with disabilities in Indonesia is still limited. The companies argue that it is difficult to meet accessibility for disabled workers because it requires a lot of funds, for instance facilities that need to be made so that the workplace accessible for people with disabilities. The level of welfare of persons with disabilities is still relatively low. This is partly due to limited access to employment opportunities. Special Region of Yogyakarta through Regional Regulation Number 4 of 2012 has made serious efforts to protect and fulfill the rights of persons with disabilities, particularly in the field of work. However, the employment of persons with disabilities in the formal sector is still low. Evidently, the results of monitoring the Special Region of Yogyakarta's Manpower and Transmigration Office in 2016, only 24 of 325 companies that have employed persons with disabilities. Therefore, this study aims to examine the Yogyakarta Special Region government program in facilitating employment opportunities for persons with disabilities. Special Region of Yogyakarta's Social Service through the activities of the Mobile Social Services Unit; providing motivation and strengthening social mentality; skills guidance; Training in Loka Bina Karya; Job Learning Practices; and some capital activities have been carried out to prepare workers with disabilities. However, skills training is considered to be traditional in nature and only trains basic level abilities. Thus, the competencies of persons with disabilities do not match the qualifications required by the company. In addition, the unavailability of accessibility is also the reason companies have not employed workers with disabilities. Furthermore, the Department of Manpower and Transmigration Special Region of Yogyakarta conducts disability-friendly labor market activities in collaboration with non-governmental organizations to increase employment opportunities for persons with disabilities. Promoting and giving rewards to companies is also carried out to encourage the absorption of workers with disabilities in the formal sector. However, there are still many companies / agencies that have not employed persons with disabilities in accordance with the mandate of Law Number 8 of 2016.
Mapping Persons with Disabilities (PWDs) in Indonesia Labor Market

The empowerment of Persons with Disabilities (PWD) has recently attracted the attention of the Indonesian government. Several initiatives have been made to empower their life, especially the establishment of Act No. 8/2016 which enhances their right to inclusive economic activities. This study aims to map PWD in Indonesian labor market. Specifically, it analyzes the characteristics of employed and unemployed PWD. It explored Labor Force Survey (Sakernas), which began to concern on disability issue in 2016. The results show that PWD prevalence varies highly among provinces led by West Sumatera, East Nusa Tenggara, and South Sulawesi and that PWD has lower labor participation rate than that of PWOD. It may indicate the significant presence of discouraged workers among PWD.
Employment Governance for People with Disabilities: Comparative Study Between Indonesia and Malaysia

People with disabilities in both Indonesia and Malaysia are facing difficulties in attaining proper jobs and salaries. This paper aims to examine employment governance in Indonesia and Malaysia in comparative perspective. Descriptive qualitative research method was employed to gather and analyze the data. To gather data, the researcher used focus groups discussions, depth interview, observation and documentation while interactive model of Miles and Hubermas was employed in analyzing the data. The informants in this research were the Indonesian Ministry of Social agency staff, the Ministry of Labour agency staff, Rehabilitation Center Manager, Yayasan Saujana staff and disability community. Meanwhile, data of employment governance in Malaysia were obtained by documentations and literature reviews. The research result shown that both Indonesian and Malaysian government have implemented several policies and program to increase the equal participation of people with disabilities in job market. Indonesia have launched Law No 8/2016 and People with Disabilities Act 2008 in Malaysia, as the basic guidance for providing inclusive employment. However, the lack of law enforcement and negative assumptions among employer toward disabled workers were becoming the main hindrances. Malaysia stakeholders were leading in providing Job Coach and placement for PWDs in comparison to their Indonesia's counterparts.

This study aims to determine the Government Policy on Accessibility of Persons with Disabilities in Finding Jobs in Pematangsiantar City. this research uses a qualitative approach. The result of this study shows Government policies related to the accessibility of persons with disabilities in obtaining employment in Pematangsiantar City are not yet fully available. This can be seen from the unavailability of programs for handling persons with disabilities from the P3A Social Service in the form of social assistance, skills training, and social advocacy for the fulfillment of the rights of persons with disabilities. The purpose of this research is to fulfill the rights of persons with disabilities to obtain jobs following their fields without reducing their rights. The research method used is normative juridical with literature study. Decent work is a right for every human being without exception. Various racial, ethnic, and religious backgrounds that are part of a human's identity do not become a barrier for him to get his right. Likewise with the physical or non-physical conditions that underlie a human being. Every human being who has a certain physical or non-physical background also has the same rights to get decent work, including persons with disabilities. The State of Indonesia ratified the Convention on the Rights of Persons with Disabilities into Law Number 19 of 2011. In the preamble of the law, it was explained that the countries that signed the convention had the obligation to promote and protect the rights and dignity of persons with disabilities and promote their participation in the civil, political, economic, social, and cultural spheres is based on equal opportunities, meaning that the Indonesian Government is obliged by law to fulfill the rights of persons with disabilities, especially about the right to work in Indonesia.
