The banking industry has experienced an increase in the services that customers can provide due to the emergence of the industrial revolution 4.0, so it has become more innovative. Using this information technology provides innovation in the form of digitizing the banking sector from various sides. This research aims to see how developments occur in the Indonesian banking industry, which has begun to be digitized. This research will be carried out using a qualitative approach and literature study methods. The data obtained came from various research results that discussed the digitalization of the banking sector that occurred in Indonesia. This study found that industries that want to survive need to adopt new technologies to stay ahead or stick with existing conventional systems and then slowly disappear.

However, banks are particularly concerned about reputation risk, which has an impact on customer trust and is crucial for banks to manage. The Urgent Need to Amend the Indonesian Law on Currencies to Face the Digital Age

This research focuses on Indonesian Law No. 7 of 2011 on Currency. Over the past ten years, information technology has developed so rapidly that it has been necessary to take another look at whether this law is still relevant now and in the near future. The research uses normative legal analysis methods with a conceptual approach, analytical approach, comparative approach across multiple countries, and case studies. The rapid development has left the law behind when addressing violations of the currency law. This study aims to obtain the concept of electronic money supervision, especially technological risk, including operational risk in applying electronic money policies issued by Bank Indonesia, namely Bank Indonesia Regulation Number 20/6/PBI/2018 concerning electronic money. The legal problem in electronic money is that if a crime occurs in the electronic money transaction technology system, it will harm various parties, one of which is the most disadvantaged by electronic money users. The research method utilized in this study is a normative juridical approach and a descriptive-analytical research specification that investigates secondary data in the form of primary legal materials based on Bank Indonesia Regulation Number 20/6/PBI/2018 concerning Electronic Money. According to the findings of the study, the purpose of issuing electronic money is to build a seamless, fast, safe, and effective payment system. However, electronic money crimes continue to occur in practice. Regulation 20/6/PBI/2018 of Bank Indonesia, changes must be made by adding an article regarding risk management of data backup systems; this is to anticipate when the network, application, or electronic money system is disrupted. From the research, it can also be concluded that the addition of an article regarding risk management of backup data systems in Bank Indonesia Regulation Number 20/6/PBI/2018 aims to reduce the potential risk in the event of a network, application, or electronic money system disruption so that it is beneficial for financial authorities, users, and electronic money providers.

Financial Technology: Legal Challenges for Indonesia Financial Sector

The global financial services sector is transforming as technology advances. Various types of technology based innovative financial business models or financial technology (fin-tech) are growing rapidly around the world, including Indonesia. The Financial Stability Board (FSB) incorporates the fin-tech progress in its work plan in 2017 in the perspective of financial stability. In Indonesia, the Financial Services Authority has issued the Financial Services Authority Regulation No: 77 /FSAR.01/ 2016 on Technology-Based Lending and Borrowing Services to provide a legal basis for fin-tech activities, in particular services with peer to peer lending models. In practice, fin-tech in Indonesia is not only used to facilitate lending and borrowing, but also used for other business models, especially start-up business, investment and social activities, which are not included in the scope of lending and borrowing. On the other hand, fin-tech development in Indonesia is expected to contribute to economic development, particularly in facilitating micro, small and medium enterprises to gain access to finance. The advantages of fin-tech include cost efficiency and ease of access to finance, but on the other hand there are some obstacles and risks that potentially arise, such as credit risk, insufficient technology, misuse of funds and user/consumer data and protection of national interests such as money laundering as well as disruption to monetary stability. Therefore, in addition to the need for comprehensive regulation, supervisory aspects by the financial services authorities are urgently needed to make fin-tech a part of the financial services sector.
One of the challenges financial institutions is how to adapt to a changing business environment, increasingly demanding and differentiated customer preferences, digitalization and technological change. Using a documentary analysis approach, the article navigates the ramifications of API based open banking, Block Chain Technology (BCT) and entrance of Fintechs, Big technology companies (Big Tech1) and Telecommunications companies (Telcos on the performance of general banking sector and financial system stability. Democracy is idealized as a government system that provides space for citizens to be freely involved in the governance process. This space can be in the form of freedom of opinion and expression. However, the concept of freedom found in democracy often gives birth to a number of issues and paradoxes that have the potential to threaten the sustainability of democracy itself, such as the potential for the emergence of social conflict, social disintegration, segregation politics, and negative excesses as the result of the strong identity politics. The presence of the Law on Electronic Information and Transactions (EIT Law) has a strategic role in safeguarding the future and to face challenges of democracy in Indonesia by applying restrictions to the concept of freedom. This is in line with efforts to realize the principle of democratize rechstaat (democracy within the state of law) that seeks to implement democracy on the social order for the citizens. This article focuses on the analysis of the role of Law No.11 of 2008 concerning Electronic Information and Transactions as one of the legal instruments that strives for the realization of social order in the implementation of democracy to minimize the emergence of democratic paradoxes by analyzing the application of the law as this paper's research method. This article is expected to provide a new perspective on the importance of implementing the legal instrument in the form of EIT Law to realize the concept of democratize rechstaat in Indonesia.
