Legal Protection Of Children In Human Rights Perspectives
This study aims to analyze the legal protection of children in the perspective of human rights. The type of this research is socio-juridical or including descriptive research with a non-doctrinal approach, which views law as a socio-empirical symptom observed in experience. For that reason, it not only examines its normative aspects, but also the law as in its reality. The results of the study are legal protection of children in the perspective of human rights being poorly implemented because the government has not carried out its obligations in fulfilling children's rights so that legal violations of children still occur.
Children’s rights in post-Soviet countries: The case of Russia and Belarus
The article constructs children’s rights as a social institution relevant to the multifunctional nature of the contemporary child. In line with the interpretivist approach, the United Nations Convention on the Rights of the Child (UNCRC) is viewed as a soft law, which requires the pluralization of practices towards international regulations. The juxtaposition of two key approaches to the UNCRC, the double status of the child and the dilemma of public versus private, frames the investigation of the current issues in Russia and Belarus through the discourses operating around children’s rights. The comparison highlights the common shortcomings and the peculiarities, clarifying the possible strategies for refining the implementation of children’s rights in post-Soviet countries.
This paper presents a vision of the figure of the Lawyer of the child and adolescent, considering the concepts derived from the International Convention on the Rights of the Child, as well as the observations of some Human Rights Organizations. Considering at all times the General Law on the Rights of Children and Adolescents that stems from the Political Constitution of the United Mexican States, thus providing a framework for reflection on the Rights of Children and Adolescents in the procedural sphere. Emphasis is placed on the right to be heard, the best interest of the child and due legal process, with the clear perception that all children have the fundamental right to be heard and the institutions must provide them with the pertinent information related to this right, so that they can request, by themselves, the assistance of a lawyer, who in addition to ethical characteristics, must be equipped with specific techniques and have a specialization in this regard.

Since the mid-2000s, Russia has increased its efforts to strengthen the legal rights of children and to improve the systems of social assistance to vulnerable families in line with the UN Convention of the Rights of the Child. The reform drive has met fierce resistance by a grassroots mobilization in defence of ‘traditional Russian family values’. Child rights are conceived of as weapons in a Western moral war against Russia, but simultaneously, the popular appeal of the campaign stems from a profound distrust in Russian state administrators, who purportedly use the CRC for personal gain. This paper suggests that this disbelief makes the protesters locate notions of citizenship primarily to the intimate social sphere, prioritizing ‘parental rights’ rather than ‘civil rights’ defined by the state-citizen relationship. It is also suggested that the confidence of citizens in their own state administration must be considered if the Convention is to be successfully implemented.
