Didn't know about localizations but was aware of the versions (hence my attempt to find a way to fallback to something DFSG-compatible ;-) Unfortunately this makes things even worse and therefore such theme shall not enter main.

Since the license is some version of some localized CC-by-sa-nc, I would say that this theme has no chance to enter main: as far as I know, the non-commercial (nc) license element makes it non-free (even from the "not so strict" point of view of the FTP Masters...).
