O Conselho Nacional de Justiça (CNJ) aprovou a Resolução nº 348, que estabelece di-retrizes e pro... more O Conselho Nacional de Justiça (CNJ) aprovou a Resolução nº 348, que estabelece di-retrizes e procedimentos a serem observados pelo Poder Judiciário com relação ao tratamento da população LGBTI privada de liberdade. Dessa forma, a determinação do local de privação de liberdade da mulher trans/travesti cabe à magistratura após a consulta à pessoa sobre sua escolha em decisão fundamentada. Esse artigo se baseia em pesquisa de campo exploratória a partir de uma análise multissituada e apresenta como objetivo principal refletir, com a lupa da criminologia queer, sobre a existência de um local “ideal” nas prisões brasileiras para o cumprimento de pena pelas mulheres trans/travestis. A metodologia abrangeu abordagens qualitativas, a partir de entrevistas com nove travestis e visitas in locu. O quadro que apresentamos aponta para a impossibilidade de idealizar um espaço adequado. EnglishThis article is the result of an exploratory multisited research that aimed to analyze the... more EnglishThis article is the result of an exploratory multisited research that aimed to analyze the housing and conditions of the GBT population in prisons in Pernambuco, and aims to present, from the Pernambuco experience of the Curado Complex, the importance of the Right to face logic (binary and homophobic) of the jail. In this vein, it was necessary to catalog what existed in the normative scope on LGBT incarceration, in an approach that involves the three constituted Powers, as well as to carry out a quantitative research (documentary research) in MPPE, especially IC no 16004-0/8 and the Curado Complex Inspection Report. Equally important, it was the observation of a public hearing, where it was discussed the guarantee of right of the GBT population of that penitentiary complex.
