Children constitute vital stakeholders in the nation's development. Nonetheless, they are frequen... more Children constitute vital stakeholders in the nation's development. Nonetheless, they are frequently under-represented in various situations, including child sexual grooming ("CSG") issues. In most CSG situations, children are oblivious that they are being exploited until they have been sexually assaulted to the degree of rape. In Malaysia, there is a growing concern about the CSG problem caused by sexual predators, which prompted the Malaysian government to enact the Sexual Offences Against Children Act 2017 ("SOACA"). The SOACA 2017 is the first piece of Malaysian legislation which specifically addressed offences on child sexual abuse ("CSA"). The paper aims to examine the correlation between legal inadequacies before the SOACA 2017 was enacted and how the SOACA 2017 addresses the cases on CSG. At the same time, the reported cases under the UK Sexual Offences Act 2003 ("SOA") will be referred to as well, as SOACA 2017 was modelled after UK SOA 2003.

The research problem is how the basic principles of diversion for the settlement of juvenile criminal cases in Indonesia? How is the implementation of the principles of diversion in juvenile court practice in Indonesia? This research is a normative legal research, namely research that uses library materials or secondary data consisting of primary legal materials, secondary legal materials as the main data. The results of the study concluded that the principles of diversion in juvenile court practice in Indonesia are guided by the principles of child welfare that exist in international instruments and national legal provisions, which consider the interests of victims, the welfare and responsibility of children, avoidance of negative stigma, avoidance of retaliation, community harmony and decency, decency and public order. Section 92 of the Maldives Penal Code (9/2014) reserves the capital penalty for the most serious ... more Section 92 of the Maldives Penal Code (9/2014) reserves the capital penalty for the most serious homicides, and the law tries to reduce the imposition of capital punishment by rigidifying the procedural requirement. However, the case law demonstrates the opposite effect. This article seeks to advance therapeutic values of procedures and promote less severe punishments in murder cases by utilising knowledge from therapeutic jurisprudence and sharia. To validate the research claim, three randomly selected cases were examined. According to the findings, current court practises in murder cases do not promote therapeutic values or result in less severe punishment. This incident emphasises the importance of digital tools, such as the Internet and ICTs, in exercising online rights to peaceful assembly and association. Given the above, this article attempts to deliberate on transforming rights to the peaceful assembly from offline to online and the legal challenges attached. The authors argue that the right to peaceful assembly and association is vital to ensuring enhanced transparency and accountability in implementing human rights policies within countries. Children's involvement in school disciplinary problems is often a predictor of their involvement ... more Children's involvement in school disciplinary problems is often a predictor of their involvement in crime in the future, resulting in them coming into contact with the criminal justice system. Therefore, teaching final-year law students the subject of criminal procedure, particularly governing the juvenile justice system, is essential for legal practice, especially when the legal rights of the children need to be protected since they are vulnerable to the adverse effects of the juvenile justice system. In this connection, the objectives of this paper are (a) to examine the underpinning causes behind children's involvement in disciplinary problems in schools as predictors of their future involvement in crime; (b) to analyse the existing legal framework governing the juvenile justice system in Malaysia that forms part of the subject of criminal law procedure, and (c) to examine the importance of teaching criminal law procedure subject to final-year law students in preparing them for legal practice, especially when dealing with juveniles in the juvenile justice system. A qualitative research design is undertaken to explore the significance of teaching criminal law procedure to final-year law students by undertaking library-based research and an examination of content analysis, drawing from both primary and secondary sources. The findings in this research demonstrate that children who commit disciplinary problems in schools, such as truancy and bullying, will eventually come into contact with the criminal justice system, and their legal rights need to be protected. This research is significant in meeting the university's mission, vision and values and supporting the national framework for reducing crime rates and strengthening crime prevention initiatives. Contribution/Originality: This study contributes to the existing literature review in highlighting the integral aspect of incorporating the teaching of juvenile justice system in the criminal law procedure subject to help prepare the final-year law students in the legal practice.

Penglibatan banduan muda lelaki dalam jenayah dan tingkah laku delinkuen telah mencetuskan permas... more Penglibatan banduan muda lelaki dalam jenayah dan tingkah laku delinkuen telah mencetuskan permasalahan sosial dalam masyarakat Malaysia pada hari ini. Namun begitu, kajian berkaitan penglibatan banduan muda lelaki dalam jenayah dari perspektif faktor kefungsiaan keluarga masih kurang diberikan penekanan dan memerlukan penelitian lanjut. Sehubungan itu, kajian ini dilakukan bertujuan untuk meneroka aspek kefungsian keluarga yang membawa kepada tingkah laku jenayah dalam kalangan banduan muda lelaki di salah sebuah Sekolah Integriti di Malaysia. Kajian ini menggunakan teknik temu bual mendalam di mana seramai 12 orang banduan muda lelaki telah ditemu bual. Kaedah penyelidikan kualitatif dan pemerhatian secara langsung telah digunakan bagi mengutip data di dalam kajian ini. Peserta kajian dipilih berdasarkan persampelan pemilihan berkriteria dan transkrip temu bual dianalisis dengan menggunakan kaedah tematik. Hasil kajian mendapati empat tema berkaitan kefungsiaan keluarga iaitu kekurangan kasih sayang, keluarga bermasalah, dendam terhadap ahli keluarga dan keterlibatan ahli keluarga dalam jenayah. Hasil dapatan kajian ini boleh dijadikan sebagai garis panduan untuk membangunkan modul-modul di sekolah untuk mengelak remaja dan pelajar sekolah daripada terlibat dengan jenayah dan tingkah laku delinkuen. Selain itu, kajian ini juga menjadi manfaat bagi institusi kekeluargaan dan masyarakat dalam memahami faktor-faktor penyebab tingkah laku delinkuen dalam kalangan remaja dengan lebih mendalam.

Lengthy detention at this stage is detrimental to the well-being of child offenders because of the trauma they experience while being detained. However, the effectiveness of the current system in preventing child offenders from being detained at the pre-trial process in Malaysia remains an open question because of the high numbers of child offenders being detained at the pre-trial process. The increasing numbers of child offenders serving sentence in the institutions across Malaysia is... more The increasing numbers of child offenders serving sentence in the institutions across Malaysia is worrying. However, the effectiveness of the current system in reforming and rehabilitating the child offenders remain an open question because of the rates of reoffending among child offenders. The objectives of this paper are to examine such issues by highlighting theories underpinning diversionary measures that call for the departure from the retributive system that is already entrenched in the juvenile justice system in Malaysia. A mixed quantitative and qualitative approach has been adopted to identify the rates of reoffending among 432 child offenders who participated in the study. The findings revealed that despite undertaking rehabilitative programmes in the institutions while serving sentence, the rates of child offenders who reoffended are increasing.

The adverse effects of the pre-trial process on child offenders are damaging, particularly on the... more The adverse effects of the pre-trial process on child offenders are damaging, particularly on their mental, emotional and physical developments. This study adopted the qualitative design, and the results indicate that the majority of the child offenders affirmed that they were subjected to some forms of ill-treatment during the pre-trial process, particularly during the investigation stage, where they are subjected to questioning. Thus, the results can facilitate the policymakers in strengthening and developing the current laws and policies and to introduce diversion programmes as an alternative to the juvenile justice system in Malaysia. Namun begitu, kajian berkaitan penglibatan banduan muda lelaki dalam jenayah dari perspektif faktor kefungsiaan keluarga masih kurang diberikan penekanan dan memerlukan penelitian lanjut. Sehubungan itu, kajian ini dilakukan bertujuan untuk meneroka aspek kefungsian keluarga yang membawa kepada tingkah laku jenayah dalam kalangan banduan muda lelaki di salah sebuah Sekolah Integriti di Malaysia. Kajian ini menggunakan teknik temu bual mendalam di mana seramai 12 orang banduan muda lelaki telah ditemu bual. Kaedah penyelidikan kualitatif dan pemerhatian secara langsung telah digunakan bagi mengutip data di dalam kajian ini. Peserta kajian dipilih berdasarkan persampelan pemilihan berkriteria dan transkrip temu bual dianalisis dengan menggunakan kaedah tematik. Hasil kajian mendapati empat tema berkaitan kefungsiaan keluarga iaitu kekurangan kasih sayang, keluarga bermasalah, dendam terhadap ahli keluarga dan keterlibatan ahli keluarga dalam jenayah. Hasil dapatan kajian ini boleh dijadikan sebagai garis panduan untuk membangunkan modul-modul di sekolah untuk mengelak remaja dan pelajar sekolah daripada terlibat dengan jenayah dan tingkah laku delinkuen. Selain itu, kajian ini juga menjadi manfaat bagi institusi kekeluargaan dan masyarakat dalam memahami faktor-faktor penyebab tingkah laku delinkuen dalam kalangan remaja dengan lebih mendalam.

However, the effectiveness of the current system in reforming and rehabilitating the child offenders remain an open question because of the rates of reoffending among child offenders. The objectives of this paper are to examine such issues by highlighting theories underpinning diversionary measures that call for the departure from the retributive system that is already entrenched in the juvenile justice system in Malaysia. A mixed quantitative and qualitative approach has been adopted to identify the rates of reoffending among 432 child offenders who participated in the study. The findings revealed that despite undertaking rehabilitative programmes in the institutions while serving sentence, the rates of child offenders who reoffended are increasing.

This study adopted the qualitative design, and the results indicate that the majority of the child offenders affirmed that they were subjected to some forms of ill-treatment during the pre-trial process, particularly during the investigation stage, where they are subjected to questioning. Thus, the results can facilitate the policymakers in strengthening and developing the current laws and policies and to introduce diversion programmes as an alternative to the juvenile justice system in Malaysia.
