Marriage in UU No. 1/1974 is referred to as a mental bond between a man and a woman as a husband and wife with the aim of forming a happy and eternal family. The ultimate goal of marriage is essentially happiness. Happiness means the benefit or justice for all family members that arise due to the marriage relationship. Marriage recording aims to realize marital order in society. It is an attempt to protect the dignity and sanctity of marriage, and more particularly for women (wives) in domestic life. ABSTRAK Menurut peraturan perundang-undangan yang berlaku di Indonesia, setiap terjadi perceraian selalu dilakukan pencatatan perceraian. Sedangkan dalam hukum Islam tidak sedikit pun dibahas mengenai bukti peristiwa perceraian. Dalam rukurn dan syarat talak pun tidak disebutkan mengenai bukti atau bahkan saksi talak. Hal ini kemudian banyak menimbulkan pertanyaan dalam masyarakat, apa yang menjadi dasar adanya aturan terkait pencatatan perceraian? Mengapa hal yang tidak diatur dalam hukum Islam ini kemudian menjadi begitu penting perannya? Marriage registration is one of the principles of national marriage law which is sourced from Law Number 1 of 1974 that, marriage registration is the recording of marriage administration handled by the marriage registrar (PPN) with the aim of creating legal order. As good citizens, we should follow the rules set by the state. Every marriage must be followed by the registration of the marriage according to the applicable laws and regulations. This study aims to determine the importance of registering marriages in the state in the perspective of maslahah mursalah in Kp Manjang Beureum Rt 06 Rw 12. This study uses descriptive qualitative data collection using interviews or interviews. The subject of the study was a marriage registration officer (PPN) in the Kp Manjah Beureum area. The results show that the activity of registering marriages in the state is very important for men and women who want to carry out marriages. Looking at the perspective of maslahah mursalah associated with maqashidu sharia which consists of aspects of hifdu din, hifdul mal, hifdun nasi, hifdul aqli, hifdul nafsi. With the recording of all these aspects, it will provide good benefits for husband and wife in the future to live a safe and good household life in accordance with religion and the state. From all the explanations above, it appears that the registration of marriages in the state is something that is ordered and recommended by the syara' and applicable legal provisions, in order to ensure the orderliness of marriage for the community. With this recording, each partner gets the benefit of the world and the hereafter as well as legal protection from the state. Besides, there are things that happen when living a household. This is at the same time an answer that Islamic law can and is even very likely to adapt to changes, adapting to every era, place and event that occurs. But still stick to the main legal basis.

The practice of sirri marriage is not only carried out by ordinary people, but also by public officials. One of the factors causing this is due to the unclear relationship of legal norms between paragraph 1 and paragraph 2 of Article 2 of the Marriage Law, resulting in different interpretations. On the one hand, it is considered that paragraph 1 and paragraph 2 are one unit, on the other hand, it is considered that the clauses stand on their own. Starting from this, this paper explains the relationship between paragraph 1 and paragraph 2 of Article 2 of the Marriage Law. Data is collected from literature review through library studies. It uses maqashid shari'ah as an analytical tool. This paper argues that the position of marriage registration is in direct contact with the dharuri needs of humans, including the legal protection of wives from physical and psychological violence (hifdz al-nafs), the protection of property obtained during marriage (hifdz al-mal) and the protection of children born from marriage (hifdz nasl). By placing the legal relationship between paragraph (1) and paragraph (2) into an inseparable unity, from the perspective of maqashid shari'ah. So, every marriage that is held is not enough just to fulfil the pillars of marriage but also the elements of marriage registration must be fulfilled in a valid marriage.

Pemerintah telah mewajibkan pencatatan perkawinan bagi seluruh warga negara Indonesia yang telah melangsungkan perkawinan. Dengan adanya "kewajiban" pencatatan perkawinan tersebut apakah kewajiban tersebut setara dengan syarat dan rukun nikah yang telah ada sebelumnya di dalam ketentuan Agama Islam? Bila dikatakan tidak setara dengan rukun dan syarat nikah yang ada di Agama Islam, lantas bagaimana kedudukan pencatatan perkawinan dalam Hukum Islam dan Hukum Positif di Indonesia? Jenis penelitian ini merupakan penelitian hukum yuridis-normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun bahan hukum yang digunakan bahan hukum primer dan bahan hukum sekunder dengan menggunakan analisis kepustakaan. Hasil penelitian ini yaitu: 1) kedudukan pencatatan perkawinan dalam hukum positif merupakan kewajiban administratif yang tidak dapat dijadikan sebagai syarat sah atau rukun perkawinan. 2) Di dalam Hukum Islam, pencatatan perkawinan harus dilakukan untuk mendapatkan keabsahan secara hukum (normatif-yuridis) akan tetapi bukan bagian syarat untuk mendapatkan keabsahan secara agama (normatif-teologis).

The law on marital registration has juridical consequences, that marriage registration is a necessity of continuing legal actions in the form of marriage. Munakahat Fiqh does not know the name of marriage registration. The existence of marriage registration legislation creates a gap (dispute/conflict) between the law of fiqh munakahat with statutory regulations. in fiqh there is no registration of marriage. It's just that, for the sake of benefit and to avoid things muḍarat, then Islam (fiqh) recommends the existence of i'l al-nikâḥ (announcing marriage) which is then manifested in the form of wedding celebrations (walîmah al-shursh). Marriage that is not recorded at the competent authority raises many conditions, so that marriage registration is considered as a preventive measure (prevention) from the government as sadd al-dharî'ah (blocking the road).
