El Consell de Ministres (en castellà: Consejo de Ministros) és l'òrgan col·legiat del Govern d'Espanya on es reuneixen els seus membres: el president del Govern, el vicepresident o vicepresidents del Govern, si n'hi ha, i els ministres. Junior or deputy ministers such as the Secretaries of State are not members of the Council (although according to the Constitution they could be, if the Government Act included them, a constitutional provision that until today has not been used). The Monarch may also chair the Council when needed on the invitation of the Prime Minister. The ministers are proposed by the Prime Minister and formally appointed by the King. There is no requirement for the Prime Minister nor the ministers to be MPs. The ministers are the heads of a ministerial department and receive the title of "Minister". In addition to the ministers that are the head of a department, there may be ministers without portfolio, who are entrusted responsibility for certain government functions. The Council is the main collective decision-making body of the government and the only one constitutionally recognized but ministers can also meet through other government bodies such as the Government Delegated Committees. The Delegated Committees are created by the Council and composed by ministers and secretaries of state which deal with minor issues that may affect more than one ministry. The Secretary of the Council of Ministers is the Minister of the Presidency. It is regulated by Article 98 of the Spanish Constitution and by article 5 of the Government Act of 1997. Habitualmente se reúne una vez por semana, los martes laborables a las 10:00 horas en el Palacio de la Moncloa, en Madrid, aunque en caso de ser ese martes festivo, puede trasladarse dicha reunión a otro día laborable de la semana. Además, con carácter extraordinario, pueden celebrarse a cualquier día y hora cuantas reuniones del Consejo de Ministros sean oportunas, tanto en el Palacio de la Moncloa como en cualquier otra parte del territorio nacional. También puede ser presidido por el rey de España, a petición del presidente del Gobierno, en cuyo caso el Consejo informa al rey sobre los asuntos de Estado, de acuerdo con lo dispuesto en el artículo 62 de la Constitución. La convocatoria y la presidencia del Consejo de Ministros corresponde (salvo en caso de presencia del rey) al presidente del Gobierno, actuando como secretario el ministro de la Presidencia, Relaciones con las Cortes y Memoria Democrática. Sus reuniones, de las que se levantará acta pública, podrán tener carácter deliberante y/o decisorio. En las actas figurarán, exclusivamente, las circunstancias relativas al tiempo y lugar de su celebración, la relación de asistentes, los acuerdos adoptados y los informes presentados. No podrán recogerse, en ningún caso, ni los votos particulares ni las deliberaciones que mantengan los distintos miembros del Gobierno, ya que éstas son de carácter secreto, en aplicación del artículo 5.3 de la Ley 50/1997, de 27 de noviembre, del Gobierno. En cuanto al régimen de funcionamiento, a las reuniones del Consejo de Ministros podrán asistir los secretarios de Estado y otros altos cargos cuando sean convocados. Também por caráter excepcional poderá presidido pelo Rei da Espanha, a pedido do Primeiro-Ministro, cujo caso não é deliberativo, mas consultivo. A convocatória e a Presidência do Conselho de Ministros correspondem ao presidente do governo, com a atuação do Secretário do Ministro da Presidência. Suas reuniões podem ter um caráter decisório ou deliberativo, levando-se em conta as atas dessas reuniões, que se figuram exclusivamente, as circunstâncias relativas ao tempo e ao lugar de sua celebração, a relação de assistentes, as modalidades e relatórios. Em quanto ao regime de funcionamento; as reuniões do Conselho de Ministros poderão assistir os Secretários de Estado quando são convocados. As deliberações do Conselho serão secretas. Além disso, como um órgão colegiado, a sua vontade se forma através da maioria absoluta dos seus membros. Sua origem histórica está nas reuniões regulares com o rei e seus secretários de Estado e do despacho durante o século XVIII. Foi criada como um órgão colegiado mediante o Decreto Real de 19 de Novembro de 1823, pelo que ordena a S.M para o acerto de suas deliberações a formação de um Conselho que será chamado de Ministros, sendo estes os Secretários de Estado e do Despacho. Atualmente, é regida pelo artigo 97 da Constituição espanhola de 1978. Exerce a função executiva e a potestade regulamentar: * Iniciativa legislativa, por si próprio ou um projeto de lei que aprova o projeto de lei e submete a aprovação pelo Congresso de Deputados; * Dita normas com força de lei que o Congresso dos Deputados a delega; * Dita decretos e leis por urgente necessidade; * Garante o cumprimento de tratados internacionais e as resoluções de órgãos internacionais e supranacionais; * Potestade regulamentar; * Elaboração de projetos de planificação, orçamentos gerais do Estado. Embora na Espanha o governo seja o órgão predominante do Estado, como ocorre em muitos países, não significa que não esteja sujeita a qualquer controle, o Governo, tal como previsto no artigo 108 da Constituição, responde solidariamente à gestão política ante ao Congresso de Deputados. (en) Since the Divine Providence led me to the Throne of this great Monarchy I have wished to promote, with all my strength, its prosperity. The Almighty wanted to favor my good intentions by arranging that, with the various events and vicissitudes of my reign, my experiences be increased, and my knowledge rectified: and this is the inheritance that it seemed to me to leave to my beloved vassals, reduced to perpetuate in them and in their government and constitution the progressive succession of the lights and maxims that I have acquired. To this end I have resolved that, in addition to the Council of State, which will be convened when I, or my successors have it convenient, there is a Supreme Board, also of the State, similar to the one currently held by my verbal orders, composed of all the Secretaries of State and of the Universal Office: to which, in cases of gravity that occur, the other Ministers of the same Council of State appointed by me, or those of other Councils, or also the Generals, will concur; and educated and jealous people who believe they are useful or necessary. This Board must be ordinary and perpetual, and must be convened once at least every week, being held in the [headquarters of the] First Secretary of State , even if this or another of the ministers does not attend, without any label or formalities of precedence between the concurrent, which only serve to prevent or delay my service and the good of the crown. (en) Article Two.- It is also named Generalissimo of the national forces of land, sea and air, and is conferred the position of General Head of Operations Armies. (en) Article third.- This proclamation will be solemnly covered, before adequate representation of all the national elements that make up this liberating movement, and from it the opportune communication will be made to the foreign Governments.
